Application for Minor Subdivision Review
SUPPLEMENTAL INFORMATION SUBMISSION # 3
1. Mineral Rights Extensive research has been completed on the mineral rights
associated with the subject property. All documents of record were reviewed at
the Garfield County Clerk’s office with the assistance of the Clerk. Those
documents are now incorporated into his submission. This research shows no
reservation of mineral rights and as such all rights currently track with the property
and the Owner, Cynthia Kinney. In the Supplemental Information Submission # 1,
a reference was made to a reservation of mineral rights in 1923 by Jean Good.
This statement should be stricken, it is inaccurate.
2. Access Driveway An access driveway has been proposed which provides legal
access to both Lots 2 and 3. This driveway intersects Cattle Creek Road and has
been designed to comply with all applicable County standards. It should be noted
that an existing driveway bisects proposed Lot 3, providing access to a lot under
separate ownership just uphill of this property (see Plat Map). This would provide
physical access to Lot 3 but legal access has not been discovered. The access
from the neighboring parcel which connects the driveway to Cattle Creek Road has
been found. The easement obviously exists as the lot above the Kinney proposed
Lot 3 has changed hands within the last five years and this is the only legal access.
It is simply a matter of continued research to find the documentation. The Kinney’s
preference would be to use this access and not construct the drive proposed on
the plan. If the easement exists and they are beneficiaries this will be the case. If
not, they intend to approach the neighbor owning the property between proposed
Lot 3 and Cattle Creek and try to secure an easement over the existing road. Since
the Kinney’s do not have ultimate control over this access, the submission
proposes a legal access to proposed Lot 3 that is 100% in the applicants control
providing legal access to both Lots 2 and 3.
3. Cost estimate for proposed driveway and culvert. This cost estimate takes into
consideration that Jake Kinney, the applicant’s son and ultimate owner of Lot 3 is
an excavator by profession and will do this work himself and is labelled “Cost-
Owner. Also, a cost if completed commercially has been provided also even
though this is unlikely.

Dear Tom:
Thank you for the additional submittals you have provided in response to our
completeness review and for meeting with me last week. It was good to be able to go
over the details of your application and how certain waiver requests may be appropriate.
Pursuant to our meeting your application is still not complete and has not been
scheduled for a Director’s Decision.
We have received your request for an extension of time to complete your Application. I
have met with Sheryl Bower, Director of the Community Development Department and
she has approved an extension of an additional 45 days to provide all required
materials. The extension will expire on October 3, 2016. It is recommended that you
provide the additional required materials well in advance of the expiration to allow staff
time to review the information. In addition, if waiver requests are being added to your
submittal a meeting with staff to go over the waiver requests prior to re-submittal is
recommended.
As we discussed at our meeting, you will need to provide a new electronic copy (in pdf
format) of the complete application including all supplements. Please call or email with
any questions regarding the remaining completeness items and your extension request.

Dear Tom:
Thank you for the detailed submittals you have provided on behalf of Cynthia Fox for
the Kinney Minor Subdivision Application. Our completeness review included input from
the County Attorney’s Office and has identified a several items that need to be
addressed or clarified prior to a determination of technical completeness. Please
respond to the following items:
1. For mineral rights ownership the application references the deeds for the
property. A clarification needs to be provided with a list of mineral owners and a
description of how the research was completed.
2. The vicinity map included on the plat does not meet the submittal requirements.
It should be reformatted to an 8” x 11” size to allow attachment to the public notice and
include areas within approximately 3 miles.
3. The water supply plan does not adequately document the legal, physical and
adequate (quality) water supply for the proposed lots. Please contact me for more
information on this item. The proposal to delay drilling and testing of the new wells to
after potential approval by the County but prior to filing the plats will require a formal
waiver request. The water supply plan needs to address all three of the proposed lots.
4. The waste water management plan needs to be updated to include information
on the OWTS (ISDS) for the existing home along with general information on the
percolation test locations for the proposed lots and anticipated location for the leach
fields. This information can be included on the site plan and has some bearing on
future options for locations of domestic water wells.

5. Will serve letters for other utilities such as electric should be provided or other
evidence of ability to serve the proposed lots (i.e. email communication).
6. The County Attorney’s Office has requested copies of any Title Work on the
Property. This will allow review of any lienholders, ensure that all easement are shown
on the plat, and assist with mineral rights research.
7. Please contact me regarding the history of the property to clarify the legal
description which includes two parcels and a past subdivision exemption that appears to
have been approved in 1975 for the property.
8. Narrative statements or commitments for future design can address most of the
preliminary engineering topics (waivers may need to be requested). However, more
detailed information needs to be provided on the access driveways to ensure code
compliance. Typical cross section details and basic engineering representations should
be adequate to confirm compliance with width, grade, curve radius, and drainage
ditches/shoulders.
A follow-up meeting or telephone conference with staff is recommended to clarify any of
the above items including whether waivers from standards and/or submittal
requirements need to be requested.
Once the above topics are addressed we can finalize our completeness review and
schedule a date for your Director’s Decision. Please note that the Garfield County Land
Use and Development Code requires that the technical completeness issues be
resolved within 60-days of the date of this letter, otherwise the application will be
deemed withdrawn unless a request for extension is submitted and approved.

This letter is to inform you that your application has been deemed Technically Complete.
Please understand that a determination of technical completeness shall not be viewed as
a recommendation of approval, finding of an adequate application, or a finding of general
compliance with any goal or objective of the Land Use and Development Code or the
Garfield County Comprehensive Plan 2030. The Application will be reviewed by Staff
and a report will be sent to you. The date upon which the Director of the Community

I have enclosed an appropriate public notice for your convenience. This document is
provided to you as a courtesy and the Applicant must verify that all information in the
notice is correct and attached including the legal description and vicinity map. It shall be
the obligation of the Applicant to correct any deficiencies in the public notice such that
proper notice in form and substance can be established. Included for your convenience
is the following outline of the process from this point.
1. Referrals will be sent out on October 19th with comments requested back
by November 9th.
2. Public Notice must be mailed by the Applicant no later than November 1st.
3. Applicant will provide a completed Public Notice Information Form along
with the proof of mailing and return receipts prior to the Director’s Decision.
4. On Wednesday, November 16th, the Director of the Community
Development Department will render a Decision to approve, approve with
conditions or deny the application.
5. The Board of County Commissioners will be provided notice of the
Director’s decision and will have a 10 day call up period to request a public
hearing.
6. If the call up time period expires without a request for a hearing from the
Board, or the Applicant, or an adjacent property owner, the decision will
become final.
7. The Applicant shall have 90 days to satisfy any conditions of approval and
submit a plat to the County in a form ready for recording. Extensions on the
time limit can be requested.

Research in the Garfield County Clerk and Recorders Office included extensive review of numerous
deeds reflected in the outline below. No evidence of mineral rights reservations were found in the
deeds. An oil and gas lease from 1936 was found. It appears based on that lease that the mineral rights
were held at that time by George and Nannie Downing.

Application for Minor Subdivision Review
SUPPLEMENTAL INFORMATION SUBMISSION # 3
1. Mineral Rights Extensive research has been completed on the mineral rights
associated with the subject property. All documents of record were reviewed at
the Garfield County Clerk’s office with the assistance of the Clerk. Those
documents are now incorporated into his submission. This research shows no
reservation of mineral rights and as such all rights currently track with the property
and the Owner, Cynthia Kinney. In the Supplemental Information Submission # 1,
a reference was made to a reservation of mineral rights in 1923 by Jean Good.
This statement should be stricken, it is inaccurate.
2. Access Driveway An access driveway has been proposed which provides legal
access to both Lots 2 and 3. This driveway intersects Cattle Creek Road and has
been designed to comply with all applicable County standards. It should be noted
that an existing driveway bisects proposed Lot 3, providing access to a lot under
separate ownership just uphill of this property (see Plat Map). This would provide
physical access to Lot 3 but legal access has not been discovered. The access
from the neighboring parcel which connects the driveway to Cattle Creek Road has
been found. The easement obviously exists as the lot above the Kinney proposed
Lot 3 has changed hands within the last five years and this is the only legal access.
It is simply a matter of continued research to find the documentation. The Kinney’s
preference would be to use this access and not construct the drive proposed on
the plan. If the easement exists and they are beneficiaries this will be the case. If
not, they intend to approach the neighbor owning the property between proposed
Lot 3 and Cattle Creek and try to secure an easement over the existing road. Since
the Kinney’s do not have ultimate control over this access, the submission
proposes a legal access to proposed Lot 3 that is 100% in the applicants control
providing legal access to both Lots 2 and 3.
3. Cost estimate for proposed driveway and culvert. This cost estimate takes into
consideration that Jake Kinney, the applicant’s son and ultimate owner of Lot 3 is
an excavator by profession and will do this work himself and is labelled “Cost-
Owner. Also, a cost if completed commercially has been provided also even
though this is unlikely.
