Okagawa LOCATION: A tract of land situated in Sections 3 & 4, T7S, R92W and Section 33, T6S, R92W; located approximately 7 miles south of Silt off County Road 331. SITE DATA: The site consists of a 270 acre tract. WATER: Individual wells SEWER: Individual Sewage Disposal Systems ACCESS: Existing access drives off County Rd. 331 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints as designated on the Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily single family residential, agricultural, and open space. Slopes on the site are moderate becoming steeper in the vicinity of the County Road. Dry Hollow Creek and County Road 331 run through the site separating one two (2) acre tract from the remainder of the site. There are no existing improvements on the proposed 2 acre lots, while two mobile homes are located on the large tract. B. Project Description: The applicant proposes to divide the 270 acres tract into three tracts approximately 2.1 acres, 2.3 acres and 265 acres in size. The large tract is served by an existing well while two additional wells are proposed for the 2 acre lots. The proposed lots have frontage onto County Road 331 but currently utilize access easements due to topography and the location of the creek. C. History: Deeds provided by the applicant indicate that no lots have been created out of this tract since 1964. III.MAJOR ISSUES AND CONCERNS 1. The applicant's submittal has been referred to the State Division of Water Resources for comments. The submittal included copies of applications to the Division for two additional well permits. 2. Soil Conservation Service, soils information on the site indicates moderate to severe limitations on septic tank absorption fields and dwellings due to slopes, slow permeability and low strength shrink -swell type soils. • • 3. Both proposed two acre lots have frontage on however, due to topography and the location both utilize existing access properties. Evidence of the easements should be provided. IV. SUGGESTED FINDINGS the County Road 331, of Dry Hollow Creek, easements across adjoining existence and legality of these 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the Exemption Plat: a) Each lot may be subject to engineered foundations and septic systems. b) Improvements on the site are subject to a 30' greenbelt setback from the high water mark of Dry Hollow Creek. c) Tlur� Q// el/744cask•-ktn/s ke q/ �/c' e t�» ti4 f1rcr� 2. That the applicant submit evidenhe of a domestic water source for each of the proposed tracts, consisting of additional well permits or other verification acceptable to the Board of County Commissioners. 3. That the applicant submit $200 per lot in School Impact Fees for the creation of two new lots. 4. That the applicant shall submit evidence of legal access easements for each of the proposed lots consistent with access drives as existing and in place. 5. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. • • August 13, 1989 To Whom It May Concern: I have recently received notification of a possible sub -division going in next to us. I would like to state that we are voting (NO) against it for the following reasons: 1. Water: Not enough water on the South side of the river. Well water is very hard to come by up Dry Hollow and most people have to put in cisterns and haul there own. Alkali is very prevalent. You could talk to the home owners here and you could also compare it to Mineota Estates. 2. The county can' tcomplete and/or fill the existing sub -divisions: such as; Peach Valley and Mineota Estates. We sure don't need more. 3. I personnally live in the coutry for privacy, open space, clean air and lack of population! I am unable to attend your meeting since it is during our working hours.
