Re: Request to Reschedule Public Hearing — Orr/Smith Subdivision Exemption
Dear Members of the Board,
On behalf of Lacy Orr and Gil Smith, I request that the scheduled public hearing on April
16, 2007, regarding the Orr/Smith Subdivision Exemption, be rescheduled to a later date.
Due to a property line dispute and subsequent property line relocation, the applicants will
formally request a sideyard setback variance which will be presented to the Garfield
County Board of Adjustment at one of their regularly schedule hearing dates. Upon
approval, we will reschedule a public hearing on the Subdivision Exemption.
Approval of the rescheduled public hearing, regarding this matter, will be appreciated.

Re: Easement for Potable Well on Lot 1 — Orr/Smith Subdivision Exemption, Garfield

Dear David,
Attached is a letter, Dated July 2, 2008. from the Bureau of Land Management ( BLM)
which acknowledges a reciprocal easement between Lacy Orr and Gil Smith and the
BLM. The easement would allow a domestic well to remain on BLM managed land
which in turn would allow a BLM access road to remain on Lacy Orr and Gil Smith's
property. The existing domestic well serves the Lot 1 of the proposed Orr/Smith
Subdivision Exemption.
I believe this is the last remaining issue with the Orr/Smith Subdivision Exemption
proposal. The other outstanding issue was a side yard setback variance. The setback
variance was approved in June 2007. I jut received Resolution No. BOA 2008-1, from
the Garfield County Building and Planning office, that confirms approval of the variance
request.
I would like to schedule a public hearing for the Orr/Smith Exemption, with the Board of
County Commissioners, as soon as possible.

from you for public acccss on a comer of BLM Road. I'he acquisition of consideration
consists of public access on a comer of BLM Road #8241 (known locally as the "Center
Mountain Road") which crosses your property in exchange for your domestic well to
remain on BLM Managed Lands, as shown on the map below.

Thanks Carole. I am assuming that since this is a permanent arrangement which is not subject to renewals?
How does this affect the shed/garage structure which is mostly on BLM property?

in the process with the BLM. Has a Land Grant (or similar) been issued? When do you anticipate this
arrangement to be finalized?

This is to inform you of BLM's intent to acquire a reciprocal right-of-way and easement
from Mr. Lacy Orr and Gil Smith for public access on a corner of a BLM Road. The
acquisition of consideration consists of a public access on a corner of BLM Road #8241
(known locally as the "Center Mountain Road") which crosses the Orr and Smith
property in exchange for their domestic well, and a small portion of the Orr/Smith
driveway to remain on BLM Managed Lands, as shown on the map below.

We are still processing the reciprocal easement but it has not yet been finalize. We hope
to complete the easement for both parties by the end of this year.
