ffiEREAS, FRANK PENNIG, has petitioned the Board of County Conrnissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
l0t (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 197? and amended Apri'l 't4, 1975, Sections 1.02.17
(d) and 3.02.01, for the division of a 20 acre tract of'land into two I0 acre
tracts each, tmre or less, and said 20 acre tract is more particularly described
as follows:
A parcel of land situated in the SEkNWk, St^l%NE%, NEkSWk,
NtlkSEk, SE'4S}lk and the StJ%SEk all in Section 19, Township
7 South, Range 87 West of the Sixth Principal Meridian,
lying Westerly of the Westerly right-of-way line of County
Road No. I00 as constructed and in place, said parcel of
Iand is described as follows:
Beginning at the South Quarter Corner of said Section 19,
thence N. 4lo 23' 40" E. 439.42 feet; thence N. 690 45'
00" }'l. 584.50 feet; thence N. 00o 54' 26" E. 1433.23 feet
to the true point of beginningi thence N. 00o 54' 26" E.
689.38 feet; thence 87o'10'48" E. 1359.26 feet along a
fence as constructed and in place; thence S. 09o 5I' 00"Il. 70.57 feet along said fence to a point on the Westerly
right.of-way line of said road; thence 148.37 feet alcng
the arc of a curve to the left, having^a radius of 1004.28feet, the chord of which bearsi s. t4o st' 46" t^l. 148.24. feet; thence S. 0lo 23' 06" E. 409.50 feet along the
Westerly right-of-way line of said road; thence West
1329.16 feet, more or less to the true point of beginning.
The above described parcel of Iand contains 20.00 acres,
more or I ess.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Corrnissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re-sale into single-family residential acreage;
and,
UHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Conrnissioneys that there is a reasonable probability of Iocating
dcmestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the
Colorado Departrent of Health, that the requested division is in accordance with
the general purposes and intent of the Subdivision Regulations of the State of
Colorado and the County of Garfield and should, therefore, be exempted from
the definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. (tSZs1 Section 30-28-101 (.l0)

(a) - (a) as amended;

by Flaven J. Cerise and carried, said 20 acre tract of
land is hereby exempted from such definition and transfer of said tract may be
made by division into two tracts of I0 acnes each, tnore or less, a'll as is more
fully described above, and further, that said exemption is conditioned upon
the Petitioner obtaining a proper Iegal description of said tracts prior to
conveyance thereof. A copy of the instrument(s) of conveyance when recorded
shall be filed with this Resolution.
