JOYCE PETERS. WHEREAS, Joyce Peters has petitioned'the Board of Qounty Commissionersof Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101(10) (a)-(d), as amended, and the Subdivision Regulations of Gar.field County, Colorado, adopted January 2, 1979, Sections 2.02.2L (d) and3.02.0I for the division of a 39+ acre tract described as follons: In Book 49A, Page.330 as recorded in the Garfield County Clerk and Recorclerrs office. tnto tracts of approximately 27r 12 and.5 acres, more or lessr rhichproposed divided tracts are more particularly described as follows: See legal description on Exhibit 'A* (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorador that theproposed division does not faIl within t,he purposes of Part l, Article 28,Title 30, Colorado Revised Statutes L973r ds amended, for the reason thatthis division of land does not warrant further subdivision review, and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there isa reasonable probability of locating domestic water on each of saidtractsr that there is adequate ifigress and egress to said tracts,that the location of septic tanks will be permitted by the Colorado Department of Hea1th, that the reguested division is not part of anexistiyrg or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the county of Garfield, and should, therefore, be exemptedfrom the definition of the terms "subdivision" and subdivided land" as setforth in C.R.S.
