BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY
JOINT PETITION FOR EXEMPTION
Pursuant to Colo. Rev. Stats. (1973) S30-28-I01(I0) (cl) r &s
amendedr the undersigned Duane PauL Piffer (hereafter referred
to as Piffer) and LeRoy M. Hauschel and Lenore M. Hauschel (here-
after referred to as llauscheLs) respectfully petition the Board
of County Commissioners of GarfieLd County to exempt by resolution
two tracts of land more full-y hereinafter described from the defi-
nition of "subdivision" and "subdivided land" as the terms are
used and defined in Colo. Rev. Stats. (1973) S30-28-101(I0) (a)-(d)
for the reasons set forth below:
1. piffer and Hauschels are owners of adjoining tracts of
land Located on old Colorado Highway 82 now known as County Road
L54. piffer owrsthe tract described on Exhibit A which is also
known by the address of 20L7 County Road 154. The Hauschels own
the tract described on Exhibit B and known as 2L27 county Road 154'
2. Due to the contours of the land and the location of the
dwelling houses on each tract, the joint petitioners desire to
trade the foLl-owing described tracts:
E. Piffer desires to convey to the Hauschels the
tract of land described as follows:
A parcel of land situated in the NlsNEk of Section 27 ,
Township 6 South, Range 89 West of the Sixth Principal
Meridian, lying Westerly of the Westerly right-of-y?Yline of oLd-Stite Highwly No. 82, now County Road 154,
and Easterly of the ienterline of the Roaring Fork River,
said parcel of land. is described as folLows:
Beginning at a point in the center of the Roaring Fork
River whence the North Quarter Corner of Section 27
bears N. 69002156" w. 1908.38 feet to a point of begin-
ning: thence s. 1602I'OO" E. 15 feeti thence s. 74o32r00"
W. 158.98 feeti thence N. I3o30'57u W. 15.01 feet; thence
N. 74032'00" E. L58.24 feet to the point of beginning,
containing 0.05 acres, more or less,
b. The Hauschels desire to convey to Piffer the
tract of land described as foLlows:
A parcel of Land situated in the NLNEk of section 27,
Township 6 south, Range 89 west of the sixth Principal.
Merd.dian, lying Easterly of the center of the Roaring
Fork River, and Westerly of the Westerly right-of-way
line of Old State llighway No. 82, now County Road 154,
said parcel of land is described as follows:
Beginning at a point in the center of the Roaring Eorkniier wh6nce thE North Quarter Corner of Section 27
bears N. 68o45'04" w. 1552.77 feet to a point of begin-
ning: thence N. 07o 40 r 00" W. L37 .34 feet; thence
N. 77oOO'OO" E. ].,25.63 feet; thence S. L3o30'57" E.
115.49 feet; thence S. 76029'03" w. 35.00 feet; thence
S. L3o30'57" 8. 20.00 feet; thence S. 76029'03" w.
L04.62 feet to the point of beginning, containing 0.40
acres, more or less,
, 3. Each of the tracts described in Exhibits A and B are impro-
ved with a dwelLing and each of the tracts have direct access to oLd
State Highway 82 now known as County Road 154 and each tract has its
own separate well and sewer system. The conveyances described in
paragraph 2a and b will not change this.
4. If this petition is granted, joint petitioners will convey
the respective tracts as set forth in paragraph 2a and b and copies
thereof wilI be fiLed with the resolution aLlowing this exemption.
