RESOLUTION tt
WHEREAS, BARTON PORTER, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17 (d) and 3.02.01, for the division of a seven (7) acre
parcel of land out of a larger tract of land, more particularly described
as follows:
Sections 10 and 11, Range 92 West, Township 6 South,
which is situated East of County Road and bordered
on the North by the Colorado River and the East and
South by the old Rising Sun Ditch, known as the
Barton Porter, Carl Short property, containing
seven (7) acres, more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage, and;
WHEREAS, the Petiticner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water o". each of
said tracts, that there is adequate ingress and egress to said tracts, that
the location of septic tanks will be permitted by the Colorado Department of
Health, that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield and that said division will actually restrict the density
of housing within said area, and should, therefore, be exempted from the
definitions of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of f-- lover) Edi 15e_ seconded by
VP (c)3 cc Z , and carried, said tract of land is hereby exempted
from such definition and the division of a seven (7) acre parcel of land may be
made out of the larger tract of land, all as is more fully described above
pertaining hereto, further that a proper legal description will be prepared prior
to conveyance of anyparcel. A copy of the instrument or instruments of convey-
ance when recorded shall be filed with this Resolution.

GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and
3.02.01, the undersigned Barton Porter
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: To sell this parcel of land contain-
ing a parcel of land in Section 10 and 11, Range 91 West, Township
6 South, which is situated East of County Road and bordered on the
North by the Colorado River and the East and South by the old Rising
Sun Ditch, known as the Barton Porter, Carl Short property, containing
7 acres, more or less.
