WHEREAS, BARTON PORTER, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17 (d) and 3.02.01, for the division of a seven (7) acre
parcel of land out of a larger tract of land, more particularly described
as follows:
A parcel of land located in Section 10 and 11, Township 6 South,
Range 92 West, containing approximately 7 acres, plus or minus,
which comrences East side of County Road#311 at South ditch bank
of Rising Sun Ditch and following said county road South to
existing boundary fence line, thence East 800 feet, thence North
to intersect South bank of Rising Sun Ditch, thence Westerly
along South bank of said ditch to point of beginning at County
Road X311.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage, and;
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that
the location of septic tanks will be permitted by the Colorado Department of
Health, that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield and that said division will actually restrict the density
of housing within said area, and should, therefore, be exempted from the
definitions of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of /;7 �-c%i'1 (7cr-I `, , seconded by
, and carried, said tract of land is hereby exempted
from such definition and the division of a seven (7) acre parcel of land may be
made out of the larger tract of land, all as is more fully described above
pertaining hereto, further that a proper legal description will be prepared prior
to conveyance of any parcel. A copy of the instrument or instruments of convey-
ance when recorded shall be filed with this Resolution.

GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and
3.02.01, the undersigned Barton Porter
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-1O1(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: For Sale: A parcel of land located in Section
10 and 11, Township 6S, Range 92 West, containing approximately 7 acres, plus
or minus, which commences East side of County Road #311 at South ditch bank
of Rising Sun Ditch and following said county road South to exsisting boundry
fence line, thence East 800 feet, thence North to intersect South bank of
Rising Sun Ditch, thence Westerly along South bank of said ditch to point of
beginning at County Road #311.
