RESOLUTION 4 "77--4''
WHEREAS, BARTON PORTER, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of a 3433 acre tract into
four (4) tracts of approximately 15, 12, 6.50, and 3399.5 acres, more or
less, and more particularly described as follows:
See Exhibits "A", "B", "C" Attached.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage, and;
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domesJc water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and intent
of the Subdivision Regulations of the State of Colorado and the County of Garfield
and should, therefore, be exempted from the definition of the terms "subdivision"
and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) -
(d) as amended;
NOW THEREFORE, upon motion of 1.6 Ifni tie q ue z. seconded by

exempted from such definition and transfer of said tract may be made by division
into 4 tracts of 15, 12, 6.50, and 3399.5 acres, more or less, all as is more
fully described on attached Exhibits "A", "B", and "C", and further that no

be filed with this Resolution.

of the Southerly line of said Section 18 and Westerly of the Westerly
right-of-way line of County Road No. 314, said parcel of land is described
as follows:
Beginning at the Southwest Corner of the E1/2SE1/4 of said Section 18, thence
Northerly 750.00 feet along the Westerly line of said E2SE1/4; thence East
800.00 feet, more or less to a point on the Westerly right-of-way line of said
County Road; thence Southeasterly along the Westerly right-of-way line of
said County Road to a point on the Southerly line of said Section 18; thence
Westerly along the Southerly line of said Section 18, 1090.00 feet, more or
less to the Southwest Corner of said E1SE1/4, the point of beginning.
The above described parcel of land contains approximately 15.00 acres,
more or less.
