A RESOLUTION CONCERNED WTTH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION REGULATIONS FOR BARTON PORTER
WHEREAS, Barton Porter has petitioned the Board`'of County
Commissioners of. Garfield '.County, Colorado, for an ``exemption from the
,definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) - (d) , as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21
(d) and 3.02.01" for the ,division of a 3600 acre tract described as
follows:
Book .430, Page 14;6; Book 263, :Page 598 and; 599; Book 471, Page ,144; Book
471, Page 99; Book 357, Page 45;. Book 483,: Pages 682 and 683; Book 264,
,Page 535; Book 473, Page '497 as found in the Garfield County Clerk and
Recorder's office.,
into 2 tracts of approximately 5 and 3595 acres each, more or less, which
• proposed divided tracts'(s) is/are more particularly described as follows:'
Tract A:, See attached exhibit "A"
Tract B:'
The remaining 3595 acre tract as described in the Book
and Pages noted above.

WHEREAS, the Petitioner has demonstrated to.the satisfaction of ;the
Board of County Commissioners of. Garfield County, Colorado,`'that the
proposed division does not fall within thepurposes of Part 1,, Article 28,
Title 30, Colorado Revised Statutes 1973, as amended, for the reason that
the division, does not warrant full subdivision 'review, and
WHEREAS, the Petitioner has demonstrated; to the satisfaction of the '.
Board of County Commissioners of Garfield .County, Colorado, that there is
a reasonable probability of locating domestic water on each of said
tracts, that there is adequate ingress and egress to said tracts,

that the location;"of septic tanks will,be, permitted''by the Colocado
Department of -Health, that: the ;requested division is not part' of an
existing or larger development;- and-: does not"fall within the general
'purposes and intent',of' the subdivisior;' regulations of the State, of,

NOW THEREFORE, BE IT RESOLVEDthat-the division of the above described

exempted, from'such'definitionsand said tract may be divided into tracts
"A" and "B" ala as is more fully 'described above,'and said divided tract
may be"conveyed in. the form of `such smaller tracts without further
compliance with the aforesaid subdivision, statutes and regulations;
irov.ided, however, that th>i•s-,exemption is,,granted on the condition and
with: '.the express-understanding.and..agreement of` the'Petitioner(s) that no
,further exemptions be allowed on said tract "A", and that a copy of the
instr,ument.'or'-instruments of conveyance when recorded shall be filed with
this Resolution-

A parcel of land situated in the N3.._ of Section 18, Township 6 South, Range 90 West of
the Sixth Principal Meridian, Garfield County, Colorado, lying Westerly of Alkali Creel:"
County Road No. 314 and Northerly of a fence as now constructed and in place, said
parcel of land is more fully described as follows:
Beginning at a point in said fence on the Westerly side of said road whence the -Vest
Quarter Corner of Section 7 in said Township hears: N.38°28'22"W. 5022.15 feet; -
thence -N.89°58'23"[I. along said fence, 505.58 feet to a fence corner; thence
N.25°00'00"W. 325.95 feet; thence N.30°00'00"E 178.47 feet; thence S.Bc'°.58'23"r.
