SITE DATA: The site consists of a 160 acre tract. WATER: Individual well SEWER: Individual sewage disposal system ACCESS: C.R. 319 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints, as designated on the Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily agriculture/ranching and open space. B. Project Description: The applicant proposes to divide the 160 acre tract into two parcels 2 acres and 158 acres in size. (See page /0 C. History: The applicant has submitted documentation that no previous splits have occurred on this property since prior to 1973. III.MAJOR ISSUES AND CONCERNS 1. The applicant has submitted an approved well permit from the Division of Water Resources for the proposed 2 acre lot. 2. Soil Conservation Service information indicates that the majority of the site is subject to only slight and moderate soils limitation on dwellings and septic systems. 3. The two acre residential site is proposed in an area characterized by large agricultural/ranch holdings much larger in size. Where the potential for compatibility problems may exist here, it should be noted that the Comprehensive Plan outlines that it shall be the responsibility of the higher intensity residential use to mitigate any impacts. 4. The applicant has already submitted payment of School Impact Fees for the creation of one new lot. • • IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION 1. That the applicant obtain a driveway access permit, or letter stating that permit would be issued, from the Garfield County Road and Bridge Department for all new access points onto C. R. 319. 2. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. � Q 5w -s4- " 4 kJ-` pie"( `s'`' ktArt4t--- ot& 6-//,/ • • EXPLANATION FOR EXEMPTION REQUEST Applicant desires to grant a two -acre parcel to Ed and Denise Elder in return for years of friendship and assistance to him. This is sparsely populated area. The community will benefit by having another home in the area. This is a corner parcel with no access problems and with utilities nearby. No agricultural land will be harmed. /6
