Re.. Senate Bi77 35 Exemption
Chuck Piffer
Gentlenen:
?he above exemption request has been reviewed bg this office.
The request as protrDsed gnses a problem telated to the ptovision of
sewage treatment to flte Tots tjaat would be created bg the division.
tut existing central sewage tredtment pTarx,is in existence in this
area serving severaT conuterciaT establishrrcnts. It is not cTear if
the petitioner intends, ot would be abTe to connect the snaLler Lot
of .45 acre onto.xhis sgstem. According to Section 4.04.05 of the
Garf ieLd Countg Zoning ResoJ.ution, xhe a.bowe Lot would nox be eTigibl-e
for an individuaT sewage dispnsaT sgstem for it would not meet flze
minitmtm Lot size.
AdnittedTg, the size of this Lot is not at variance from the ordinance
bg a sigmificant anrount, however, it does point out what could becone
a probTem in the future. Granting of this request without the
guarantee that it would be pnssible to utiTize the existing central
tneatment plant, couTd estabTish a precedent wherebg other Tots might
reguest division without assurErnce that adequate sewage disgnsaT couid
be provided.
Prior to ang action being taken on this request, I feeT the petitionet
shouTd provide evidence that sewage treatnent could be provided bg the
existing centtal sgstem nq,r serving this area.
unTess fh:s js accomplished, I do not feeT the intent of the Subdivision
Regalations wouLd be cattied out in the considetation of this request.
