county, colorado, adopted september 1, 1972 and amended April
L4, L975, sections 1.o2.17(d) and 3.02.01, the undersigned
HENRY JAMES PARUszEwsKr and IIAR]AN v. pARUszEWsKr, respect-
fully petition the Board of county commissioners of Garfield
county, cororado to exempt by resolution a parcel of rand
situate in Sections 23 and 26 of Township 4 South, Range 9I
west, more fully herBinafter described, from the definitions
of "subdivision" and ',subdivi-sion Iand.,, as the terms are
used and defined i" F.R.S. (1973) Section 3o-28-I01(a) (d)
and the Garfield coulrtv subdivision Regulations, for the
reasons stated below:
(1) That your fetitioners have contracted to purchase
said trict of rfrra if they can obtain this requested
exemption. This tract contains aporoximately 45 aeres
and petitioners wish to divide it into three (3) parcers

The highest and best use appears to be as rural home-
sites. PetitiQners feel that the division of said 45
acre tract intd three smaller tracts should be exempted
from the definition of the terms "subdivision" and
"subdivided land", since their intent is not to increase
the density of the 1and, hrt merely to make proper use
of it.
(4) That the clorrect and proper descriptions of the
parcels of land to be divided is not available at this
time, but an accurate survey of such parcels will be
made by a licensed surveyor if this petition is granted,
and copies thergof will be delivered to the Board of
County Commissioners of Garfield County, Colorado, for
its records and use prior to transfer of title by your
petitioners.

As per your request, we have made a study of the flood p'Lai.n along Main E1k
Creek on a part of H.E.S. No. 54, Sec.26, T. 4 S., R. 9L W. as lt relates
to a peak flow of 7000 C.F.S. Ttris 7000 C.F.S. figure as conflroed wtth
RobertWitkowski County Planner, represents the 100-year flood flow as
given to him by the U.S. Army Corps of Engineers.
Our study lnvol-ved a field sunrey to determlne the stream cross sectlons
at three (3) points within the property. By use of the Mannl-ng formula we
calculated the maximum expected water leve1 at each sectlon and have depicted
both sections and water levels on a plan. In addition to the above plan we
have indicated the 7000 C.F.S. flow flood plain Llne on the boundary survey
map.
It is our opinion that there is adequate buil-ding area ln the South Portion
of the property between Lines "At' rnd "8" and between the 7000 C.F.S.
flow flood plain l-ine and the County road. There is also adequate bulldlag
area between Lines ttBtt and ttctt and the County road and the 7000 C.F.S. flow
fLood plain 1ine. That particul-ar area is 20 feet or better above the 7000
C.F.S. flow fl-ood plain elevation.
