HomeMy WebLinkAbout2.0 Resolution 76-61a RES0LUTT0N .fr 'lb-0 / HHEREAS, HENR;;aSZEWSKT and MARTAN PARUSZEWSKI, have petitioned the Board of County Conrnissioners of Garfield County, Colorado for an exemption under C.R.S. (1973) Section 30-28-10l (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado adopted September 1, 1972 and amended April 14, 1975, Sections l.O2.l7 (d) and 3.02.0I , for the division of a 45 . acrq tract into three tracts of approximately 12.5, 12.5, and 20 acres, more or lesS, and more particularly described as follows: See Exh ibi t'A'Attached IIHEREAS, the petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re-sale into single-family residential aireage, and, }IIHEREAS' future building sites on said tracts of 'land will be placed out- $IHEREAS, petitioners rv'il1 prepare proper Iega't descriptions for the three separate parcels prior to conveyance of any of the parcels; and IT,HEREAS, petitioners have demonstrated to the satisfaction of the Board that there is a reaonsable probability of locating domestic water on each of said three tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Deparfitent of Health, that the requested division is in accordance with the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfiild and that said division wi'll actually restrict the density of housing within said area and should therefore be exempted from the definition of. the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOt{ THEREFORE, upon motion of ln -" seconded by J/*.**- (.-;*"/ and unanimously carried said 45 acre tract of andIand is hereby exempted frcrn such definition transfer of said tract maY be b I I I made by division into 3 tracts of 12.5,12.5, and 20 acres, more or less, aII as is more fully described in the Petition pertaining hereto, furthennore, it is an express condition of this resolution that all future building sites on these parcels of land be kept out of the floodplain as depicted on Exhibit B and made a part of this resolution. A copy of the instrument or instruments of conveyance when recorded shall be fited with this resolution. Dated this Xa4 day of September, A.D. 1976.
