Subdivision Regulations for the reasons stated below:

9UBMITTAL REQUIREMENTS :An aPplication which satisfies the review criteria must be submitted withall the following information.
A.sketch map at a minimum scale of 1"=200r showing the legaldescription of the property, dimension and area of all lots orseparate interests to be created, access to a publicright-of-vrayr ond any proposed easements for drainage,irrigation, access or utilities;vicinity map at a minimum scare of L'-2000' showing the generaltopographic and geographic relation of the proposed exempLion tothe surrounding .area within two (z) miles, for which a copy ofU.S.G.S. guadrangle map may be used.Copy of the deed showing ownership by the applicantr or a letterfrom the property owner(s) if other than the applicant; andNames and addresses of ovrners of record of land immediatelyadjoining and within 2OO feet of the proposed exemptionr mineraior^rners and lessees of mineral owners of record of the property tobe exempted, and tenants of any structure probosla - forconversion; and
Evidence of the soil types and characteristics.of each type; andProof of legal and adequate source of domestic water for each lotcreated, method of sevlage disposalr dod letter of approval offire protection plan from appropriate fire district; and-rf connection to a community or municipal water or sehrer systemis proposed7 o letter from the governing bocly statin! auillingness to serve; andNarrative explaining why exemption is being reguested; andIt sha11 be demonstrated that the parcel exisLed as described onJanuary 1, L973 or the parcel as it exists presently is one ofnot more than three parcels created from a ldrger pircel as itexisted on January 1, L973.A $100.00 fee must be submitted with the apptj4at,ion.

I,IHEREAS, HENRY PARUSZEWSKI and I',IARIAN PARUSZEWSKI, have petitioned the
Board of county comnissioners of Garfie'rd county, colorado for an exemption
under c.R.s. (1973) Section 30-28-1Ol (a) - (d) as amended, and the subdivision
Regulations of Garfield County, Colorado adopted September 1 ' 1972 and amended
April 14, 1975, Sections I .02.17 (d) and 3.02.01, for the division of a 45 .
acre tract into three tracts of approximately 12.5, 12.5, and 20 acres' more
or less, and more particularly described as fol'lows:

I^IHEREAS, the petitioners have shown to the satisfaction of the Board of
County Commissioners of Garfie'ld County, Colorado, that they desire said
exemption for the purpose of re-sare into singre-famiry residential aireage,
and,
HHEREAS, future building sites on said tracts of land wil'l be placed out-
side of the depicted 100 year f'loodplain, and
I^,HEREAS, petjtioners rl|ill prepare proper lega't descriptions for the three
separate parcels prior to conveyance of any of the parcels; and
I^IHEREAS, petitioners have demonstrated to the satisfaction of the Board
that there is a reaonsable probability of locating dornestic water on each of
said three tracts, that there is adequate ingress and egress to said tracts'
that the rocation of septic tanks wiil be permitted by the colorado Department
of Health, that the requested division is in accordance with the general
purposes and intent of the subdivision regulations of the state of colorado and
the County of Garfii'ld and that said division will actually restrict the
density of housing within said area and shou'ld therefore be exempted from the
definition of the terms "subdivision" and "subdivid.ed]and" as set forth in
c.R.S. (1973) Section 30.28-lo.| (10) (4 - (d) as amended;

Iand is hereby exempted from such definition and transfer of said tract may be
made by division into 3 tracts of 12.5, 12.5, and 20 acres, more or'less, all as
is more fully described in the Petition pertaining hereto, furthermore, it is

Our study involved a field survey to determine the streau cross sectlons
at three (3) points within the property. By use of the Manning formula we
calculated the maxlmum expected hrater 1eveI at each section and have depicted
both sections and water leve1s on a p1an. In addition to the above plan we
have indicated the 7000 C.F.S. flow flood plain line on the boundary survey
naP.
It is our oplnion that there is adequate butlding area in the South portion
of the property betlfeen Lines t'At'and |tBrr,nd[ between the 7000 C.F.S.
fLow flood plain llne and the County road. Ihere is aLso adequate buil-ding
area between Llnes "B" and "C" and the County road and the 7000 C.F.S. flow
flood plaln line. Ttrat particular area is 20 feet or better above the 7000
C.F.S. flow flood plain elevation.
