PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned /4411.0g ,4.
C 04.=76 _respectfully petitioners the
Board of County Commissioners of Garfield Courjty, Colorado, to exempt by resolu-
tion the division of acre tract of land into tracts of
approximately 2c'1%e0 acres each, more or less, from the di finitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (10) (a) -(d) and the Garfield County Subdivision Regulations,
for the reasons stated below: 1) Tract is split by natural ravine as shown on attached
Plot Plan rendering joint use of proposed tracts on either side of the ravine difficult; 2) Pro-
posed tracts obtain irrigation water from different source; 3) Domestic water source is more
than adequate for two tracts; 4) Access and utilities are in place; 5) New tract of ten acres
more or less would be more beneficially used and maintained if a seperate tract; 6) -Proposed
new tract would be complementary and not offensive to any adjoining properties.
In support of this petition, the petitioner also submits the following:

and the aboved bargained premises in the quiet and peaceable possession of the said party of the second part, his
heirs and assigns against all and every person or persons lawfully claiming or to claim the whole or any part thereof,
the said party of the first part shall and will WARRANT AND FOREVER DEFEND. The singular number shall
include the plural, the plural the singular, and the use of any gender shall be applicable to all genders.

EXHIBIT "A" TO WARRANTY DEED
A parcel of land being the SWkSEk of Section 33, Township 6 South, Range
92 West of the Sixth Principal Meridian, Garfield County, Colorado, except
the Easterly 150.00 feet, being more fully described as follows:
Beginning at the South Quarter Corner of said Section 33, thence N.00°08'
42"W. along the North-South centerline of said Section 33, 1319.22 feet to
the Northwest corner of said SW'LSEk; thence N.8923'16"E. along the North
line of said SWkSEk, 1183.74 feet to a point 150.00 feet Westerly of the
Northeast corner of said SW'SEk; thence S.00 20'13"E. along a line parallel ,
and 150.00 feet Westerly of the East line of said SWZSEZ, 1318.50 feet to
a point on the South line of said Section 33; thence S.89 21'15"W. along
said South line, 1188.18 feet to the point of beginning, containing 35.91
acres, more or less.
Subject to and together with a 60 -foot road easement being thirty feet on
each side of its centerline, commencing at County Road No. 331 in the
