PROJECT NAME: Senate Bill 35 Exemption
OWNER/APPLICANT: Mark and Susan `iarfstct
LOCATION: Approximately 6 miles south of Silt
on County Road 331. See maps, pages
6 & 7
PURPOSE: To split an approximately 36 acre tract
into 2 tracts of 26 and 10 acres each
QUALIFICATION: Split by a natural feature
ZONING: A/R/RD
WATER: Shared domestic well #113064
SEWER: Individual septic system
ACCESS: Private access from County Road 331
I. COMPREHENSIVE PLAN:
District C (Rural Areas/Minor Environmental Constaints), recommending a five
acre minimum lot size.
II. STAFF COMMENTS:
1. This parcel was part of the Rifle Land and Cattle Company (Frank Taylor)
holdings. The Taylor properties have been split into 35+ acre tracts
without benefit of the County review process. This particular parcel could,
therefore, be viewed as part of a larger existing development. Should the
Board of County Commissioners deem this parcel to be part of a larger existing
development, this request could be processed through the full subdivision
procedures.
2. Should the Board of County Commissioners wish to approve this Senate Bill
35 Exemption request, the following items should be included in the legal
descriptions for the two tracts:
a. A minimum of 5 gpm of water for each parcel;
b. A maintenance easement to the well for each parcel;
c. An access easement from the County Road for each parcel;
3 The $200.00 school assessment fee must be submitted to the Planning
Department prior to signing the exemption resolution.
4. A $1000.00 Silt Bridge fee must be submitted to the Planning Department
prior to signing the exemption resolution.
The applicant would have 120 days to meet all conditions and submit all
information and fees to the Planning Department if the request is approved by
the Board of County Commissioners.
III. RECOMMENDATION:
