1 I.0,a 82 • PROJECT INFORMATION AND STAFF COMMENTS PROJECT NAME: Senate Bill 35 Exemption Request OWNER/APPLICANT: Mark and Susan Onorfski LOCATION: Approximately 6 miles south of Silt on County Road 331. See maps, pages 10 & 11 PURPOSE: To solit an approximately 36 acre tract into 2 tracts on 26 and 10 acres each QUALIFICATION: Split by a natural feature ZONING: A/R/RD WATER: Shared domestic well #113064 SEWER: Individual septic system ACCESS: Private access from County Road 331 I. COMPREHENSIVE PLAN: District C (Rural Areas/Minor Environmental Constraints), recommending a five acre minimum lot size. II. STAFF COMMENTS: 1. This parcel was part of the Rifle land and Cattle Company (Frank Taylor) holdings. The Taylor properties have been split into 35+ acre tracts without benefit of the County review process. This particular parcel could, therefore, be viewed as part of a larger existing development. 2. In recent months, the Board of County Commissioners has placed a "hold" on all exemption requests in the Divide Creek -Dry Hollow areas. Only those land splits created by some natural feature (road, creek, severe topographic changes, etc.) that prevented joint use of the proposed tracts have been approved. The applicant is requesting this property split based on a land separation by a natural feature (drainage area). After a site review on November 17, 1982, by the Planning Dept. staff, it appeared that the drainage area may in fact prevent joint use of the lands in question. However, due to the controversial nature of land splits in this area, and because of the Board's recognized concern for further development here, the Commissioners may wish to do a site review for this proposal if they are not already familiar with the site. 3. Should the Board of County Commissioners deem this parcel to he part of a larger existing development, this request could be processed through the full subdivision procedures. 4. Should the Board wish to approve this Senate Bill 35 Exemption request, the following items should be included in the legal descriptions for the two tracts: a. A minimum of 5 gpm of water for each parcel; b. A maintenance easement to the well for each parcel; c. An access easement from the County Road for each parcel; 5. The $200.00 school assessment fee should be submitted prior to signing the exemption resolution. E.
