PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned
respectfully
petitioners the Board of County Commissioners of Garfield County, Colorado, to
exempt by resolution the division of off/ / %acre tract of land into ..g

FINDINGS OF FACT, CONCLUSIONS OF LAW AND JUDGMENT
ROBERT H. RAGLE, Plaintiff,
v.
GEORGE YULE, LIZZIE YULE, GENE R. HILTON & TRAVELER'S INDEMNITY CO.,
A Conn. Corp., And All Unknown Persons who Claim any Interest In
The Subject Matter of this Action, Defendants.
THIS MATTER having come before the Court for trial to
the Court on the matters raised as between Plaintiff and Defendants
Gene R. Hilton and Traveler's Indemnity Co. and the Court being
fully advised in the premises, enters the following Findings of
Fact, Conclusions of Law and Judgment.
FINDINGS OF FACT
Testimony and exhibits admitted at trial, as well as
the stipulations of fact entered into evidence by the parties,
establish that the disputed property lies in Garfield County,
Colorado, along Garfield Creek. The common grantor to the
property in question was one R. P. Coulter. By deed dated April 18,
1914, Coulter conveyed that portion of the NE4 of the SE; of
Section 22, Township 6 South, Range 91 West, 6th P.M. to one
Adam Blackwood lying north of the county road. A small parcel
was reserved by Coulter as a way for stock to reach Garfield
Creek for water.
Sometime after the conveyance, the county road was
relocated to the south of the then -existing county road. By
deed dated November 2, 1915, Coulter deeded the strip for the
new road. The title to the old county road was never vacated.
No evidence was admitted as to when the new road came into actual
use. The evidence does support a finding and it is unargued
that the new road came into use sometime before the early 1920's.
In 1927, Coulter conveyed the remainder of his property
to L. H. Coulter, I. D. Coulter and H. A. Coulter, excepting out
the tract of land previously conveyed to Blackwood which was
referred to as containing 13 acres. It is through that conveyance
that Plaintiff relies as the successor to legal title to the
property in dispute here.
After Blackwood's death, his parcel was conveyed to
H. A. Dick, with a reference that the parcel contained 25 acres
more or less. The Blackwood parcel was subsequently sold for
delinquent taxes and a Treasurer's Deed was executed, describing
the property as lying in the NEQ of the SE4 north of the county
road and containing 25 acres. It is through succession in interest
to the property conveyed by this deed that Defendants assert
legal title.
It is stipulated by the parties that the NE1 of the
SE4 of Section 22 contains 39.63 acres more or less and that 26.6
acres lie north of the present road. The Garfield County Assessor's
records indicated that in 1913, Coult= warms assessed on 400 acres,
in 1914 and 1915, he was assessed o 275 - res, and that in 1915,
Blackwood was assessed on 25 acres. These acreage breakdowns
have continued until 1980. It is further undisputed that
Defendants and their predecessors have paid the taxes on the
disputed parcel for more than seven years.
Testimony establishes that Coulter and those claiming
under him, including Plaintiff, have used the disputed parcel
in their ranching operations, running cattle and producing hay
up to the time of this action. At no time has anyone claiming
under Blackwood used the parcel in question. The only entry onto
the property by Defendants or their predecessors was in 1980, when
Mr. Hilton moved a piece of farm machinery owned by Plaintiff from
the disputed property.
CONCLUSIONS OF LAW
Plaintiff and Defendants each claim paramount legal title
based on the chains of title referred to as the Coulter and
Blackwood chains. Defendants argue that whatever legal title
was held by others was cut off by the execution of the Treasurer's
Deed to the 25 acres north of the county road.
The Court concludes that the issuance of the Treasurer's Deed
does in fact create paramount legal title in the Defendants to that
part of the parcel located in the NE4 of the SE4. See Harrison v.
Everette, 135 Colo. 55, 308 P.2d 216 (1957). The Court notes that about
one-half of the parcel in question lies in the NWQ of the SE4 and
that as to that property, Plaintiff's legal title is paramount.
From the evidence, it is established that Plaintiff
and his predecessors exclusively possessed the parcel for more
than eighteen years under a claim of right and that the possession
was open, notorious and hostile as to that portion of the property

him b4advance pssession.
WHEREFORE-, IT IS ORDERED, ADJUDGED AND DECREED that
judgment enter for the Plaintiff and against Defendants on
Plaintiff's complaint and that title to the property in question
be quieted in Plaintiff.
IT IS FURTHER ORDERED that judgment enter for Plaintiff
and against Defendants on the counterclaim.
IT IS FURTHER ORDERED that Plaintiff be awarded his
costs in this action.
