Amendment of Parcel A of the Rakich
Exemption Plat and Boundary Line
Adjustment
APPLICANT: Roy Rakich & Nick Terliamis
LOCATION: A tract of land situated south of Glenwood
Springs near the intersection of CR114 &
Hwy 82. Section 1, Township 7 South, Range
89 West of the 6th P.M.
SITE DATA:
Parcel 1 - 3.63 ac.
Parcel 2 - 1.16 ac.
Parcel 3 — 1.53 ac.
EXISTING/ADJACENT ZONING: C/L — Commercial Limited
I. DESCRIPTION OF THE PROPOSAL
The Rakich Exemption Plat concerned two (2) parcels titled "Parcel A" and "Parcel B". An
adjacent parcel between these parcels and Coryell Lane currently exists (it is the long skinny
one on the plan and is recorded in Book 790, Page 724). This "long, skinny parcel" will be
merged into Parcel 1 (previously titled parcel A) and merged into Parcel 3. The boundaries
of the "long skinny parcel" will then be expanded to result in the shape reflected by "Parcel
2". (page 2 & 3 )
II. MAJOR ISSUES AND CONCERNS
A. Zoning: The minimum lot size in the C/L zone district is 7,500 square feet.
Commercial use may have 85% lot coverage while all other uses may cover 75% of
the lot. The maximum height of buildings is 25 feet. All required setbacks must be
met. The new lot configurations do not appear to pose any inconsistencies with the
Zoning Resolution of 1978, as amended.
Plat notes: This application was referred to the County Surveyor, Sam Phelps, on
July 22nd. To date, no comments have been received.

III . SUGGESTED FINDINGS
1. That no public notice is required for the meeting before the Board of County
Commissioners;
2. That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting;
3. That for the above stated and other reasons, the proposed amended plat and boundary
line adjustment is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County;
4. That the application is in conformance with the Garfield County Zoning Resolution
of 1978, as amended and Section 6:00 of the Subdivision Regulations of 1984.
IV. RECOMMENDATION
Staff recommends APPROVAL of the amended plat and boundary line adjustment
provided the applicant comply with Section 6:00, Amended Plat, and with then garfiet
County Zoning Resolution of 1978, as amended.

Re: Rakich Amend Plat Parcel A and Boundary Line Adjustments
Thank you for your letter dated July 1, 1999 regarding the Rakich Amended
Exemption Plat and Boundary Line Adjustment for preliminary review. By way of this
letter I wish to communicate with the Garfield County Building and Planning Department
that we hereby request that an amendment be made to Rakich Exemption Plat. This plat
amendment may be made pursuant to Garfield County Land Use Regulation: 6.01. This
Section states: "An amendment may be made to a recorded plat, if such amendment does
not increase the number of subdivision lots or dwelling units, result in the major relocation
of a road or add new roads."
At this time we respectfully request an amendment to the original Rakich Exemption
Plat. This amendment does not (1) Increase the number of subdivision lots or dwelling
units, and (2) result in a major relocation of a road or add new roads.
The reason for the application is as follows:
a. To more fully comply with Garfield County Rules and Regulations as they apply to
land division and transfer;

b. to show property conditions after transfer and joining and adjusting boundaries;
c. to indicate the original three parcels are still three parcels and that only one of the
parcel boundaries has been modified;
d. to demonstrate that Parcel 2 is a result of the merging of part of the property
described on the document recorded in book 790 page 724 with book 1007 page 047;
and
e. to show that parcel 3 is not part of the original Rakich Exemption Plat.

the original plat consisting of adjustments and titled AMENDMENT TO THE RAKICH
