PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 36 acre tract of
one - 7 acre tract
land into 3 tracts of approximatel
Ytwo - 14.50 acre tracts acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

if additional space is required)
That portion of a tract of land located in Township 4, Range 92 West,
Section 13, the NESW and NWSE, lying West of County Road 245.
Containing 36 acres more or less
from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
For resale of separate parcels.
In support of this petition the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access.
(b) Vicinity Map.
(c) Statement on source of domestic water.
(d) Statement on method of sewage disposal.
(e) 100 year floodplain information where
live stream crosses or adjoins said tract.
(f) Fee in the amount of $ 86.00

Gentlemen,
In regards to the Noennig property on [est Elk Creek please
note the following:
Two of the parcels can be served from an adjudicated spring
located on the property. Please see the attached copy of the
adjudication. It is planned that the lower of the three
parcels shall have a well drilled, however there are other
springs on the property that could serve for domestic water
purposes.
Sewerage disposal will be accomplished by installation of
aerated septic or sewerage disposal systems that comply
with State and County codes.

Re: Noenning Exemption
We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water tri-
butary to West Elk Creek, an over -appropriated stream. Since new wells
would cause injury to senior vested water rights, well permits cannot be
issued by this office and we cannot recommend approval of the Noenning
Exemption.
