SUBJECT: Charles O'Connell Subdivision Exemption
Enclosed please find a petition for exemption under the Garfield
County Subdivision Regulations, and an attached map and check in
the amount of $55 payable to Garfield County Commissioners.
I would appreciate it if after this matter has been reviewed, you
would forward a copy of your recommendations to this office, and
advise me when the matter has been set for hearing before the
Commissioners.

SUBJECT: O'Connell subdivision exemption
Dear Ray,
As you will recall, earlier last month, the Commissioners reviewed a
proposed subdivision exemption in the SW4SW4i Section 27, Tp. 7 S., R.
92 W., 6th P.M., whereby Charles and Daniel O'Connell intended to split
a forty -acre section into two parcels of 35 and 5 acres each. At that time,
the Commissioners deferred taking action, because there was some question
as to the supply of domestic water.
Since that time, the original purchaser has terminated her contract, and
we have entered into a new contract to sell the property to Mr.and Mrs.
Glenn Gaasch. The Gaasches own the 40 acres immediately to the North of
the subject water, and could resolve the domestic water situation in one
of two ways. In the first place, they have recently constructed a well
approximately 200 feet North of the property line, which could be used to
furnish domestic water to this property, if that was desired; secondly,
they own 8 shares in the Divide Creek High -Line Ditch Company, which flows
through the subject property. If domestic water were to be used, they could
use a cistern from the High -Line Ditch.
It is the Gaasches intention to use this property only for stock watering
purposes anyway, and to integrate it with their ranching operations.
I hope that this resolves the problem, and that the subdivision exemption
can be issued shortly. If you have any questions about this, please contact
this office.
Also, would you please furnish a couple of applications for Senate Bill
35 for future use.

We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water which
is tributary to Divide Creek, an over -appropriated stream. Since these
wells would cause injury to senior vested water rights, well permits cannot
be issued by this office and we cannot recommend approval of the O'Connell
Exemption.

STATEMENT ON SOURCE OF DOMESTIC WATER AND SEWAGE DISPOSAL:
This property is located some distance from any ditch, and no ditch rights
are to be conveyed herewith. Nonetheless, domestic wells have been an
acceptable alternative for providing water in this area, as have septic
tank disposal systems.
