For a variety of reasons, the Board has not rendered a decision in this matter, generally due to the granting of continuances requested by the applicant's legal counsel. Ostensibly, these continuances have been requested and granted to allow the petitioner sufficient time to address issues related to the proposed legal and physical water supply. Prior to the most recent continuance in this matter (December, 9, 1996), it was represented to staff that the applicants had engaged an engineer to evaluate the water supply and make recommendations. To date, staff has yet to receive any information in this regard. See letter, page •et• . Attached to this memorandum is the staff report provided to the Board for its December 9, 1996, meeting. That staff report was never officially presented to the Board since the applicants requested, and were granted, another continuance. Due to a lack of any information being submitted and staffs speculation that this petition has been the subject of attrition, staff can only recommend this petition be denied upon the following findings: 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That no provision has been made for an adequate source of water in terms of both the legal and physical quality, quantity and dependability. 4. That for the above stated and other reasons, the proposed exemption is not in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County.
