An application which satisfies the review criteria must be submitted with all the following

to a public right-of-way, and any proposed easements for drainage, irrigation,
access or utilities;
Vicinity map at aminimum scale of 1"=2000'showing the general topographic
and geographic relation of the proposed exemption to the surrounding area
within two (2) miles, hr which a copy of U. S.G.S. quadran gle map may be used.
Copy of the deed showing ownership by the applicant, or a letter from the
property owner(s) if other than the applicant; and
Names and addresses of owners of record of land immediately adjoining and
within200feetof theproposedexemption, mineral ownersand lesseesoftnineral
owners of recorcl of the property to be exempted, and l,enants of any structure
proposed for conversion; and
Evidence of the soil types and characteristics of each type; and

33 EARSMAN-ROCK OUTCROP COMPLEX, !2 TO 65 PERCENT SLOPESThis map unit is on mountainsides and ridges. Thisunit is 45 percent Earsman very stony sandy loam and 35percent Rock outcrop. Earsman soils are on less steepslopes, and the Rock outcrop portion is in steeperconvex areas throughout the complex.
The Earsman soil is sharlow and somewhat excessiverydrained. rt formed in residuum and colluvium deriv6ddominantry from redbed calcareous sandstone. Thesurface is covered with 5 to 10 percent fragstones.The surface layer is very stony sandy roam 5 inches
lhick. The underlying material is very channery sandy
l9r*. Depth to hard calcareous sandstone rangei from10 to 20 inches. permeability is moderately iapid.Available water capacity is very 1ow. Effectiverooting depth is 10 to za inches. Runoff is medium torapid, and the hazard of water erosion is very high.
Rock outcrop 1s mainly red sandstone.
FTUVAQUENTS, 0 TO 10 PERCENT SLOPES This broadlydefined unit consists of deep, somewhat poorly drainedsoils on flood plains and arluviar varley floors.Fluvaquents are stratified and vary widery in textureand depth to sands, gravels and cobbtes. The surfacelayer is loamy sand to fine sandy loam and silty loamto clay Ioam. The underlying 1ayers are generallysandy loam or loam stratified with sands,-graversl andcobbles. rn some areas, gravels and cobbles are on ornear the surface. permeability varies from rapid tomoderately s1ow. Available water capacity above thewater table is very Iow or low. Rooting depth is 60inches or more for water torerant planti. Runoff isslow to medium. Erosion hazard is sright to high. Thewater table fructuates between depths of 0.5 and 2feet, during spring and summer. These soils aresubject to brief , occasional floodi-ng late in spring i'

MORVAL*TRIDELL COMPLEX, 12 TO 50 PERCENT SLOPES ThESEsoils are on aIIuvial fans and sides of mesas. Thesoils formed in reworked alluvium derived from basaltand sandstone. The Morval soil makes up about 55percent of the unit, and the Tridelr sorl makes upabout 30 percent.

Iow to low. Effective rooting depth is 10 to 40inches. Runoff is very rapid, and erosion hazard isvery high.
The Camborthids soil is shallow to deep andwell-drained. . It formed in residuum and colluvium
derived dominantly from sandstone shale and basalt.
The soils have a slight increase in clay in the subsoil
and generally are clay loam or loam. They are normally
stone free throughout the profile. Scattered basaltstones, cobbles, and sandstone rock fragments cover thesurface. Permeability is moderate. Available watercapacity is low to moderate. Effective rooting depthis 15 to 50 inches. Runoff is rapid, and the hazard ofwater erosion is high to very high.
Rock outcrop occurs on very steep slopes, canyonslopes, cliffs, and steep. mesa edges.
TRIDELT-BROWNSTO STONY SANDY LOAMS, 12 TO 50 PERCENT
SLOPES, EXTREMELY STONY This map unit is on terrace and
mountainside slopes. This unit is 45 percent Tridell
and 35 percent Brownsto. The surface is scattered with5 to 10 percent stones.

33 EARSMAN_ROCK OUTCROP COMPLEX, 12 TO 65 PERCENT STOPES
This map unit is on mountainsides and ridges. This
unit is 45 percent Earsman very stony sandy loam and 35
percent Rock outcrop. Earsman soils are on less steep
ilopes, and the Rock outcrop portion is in steeper
convex areas throughout the complex.
The Earsman soil is shallow and somewhat excessively
drained. It formed in residuum and colluvium derived
dominantly from redbed calcareous sandstone. The
surface is covered with 5 to 10 percent flagstones.
The surface layer is very stony sandy loam 5 inches
thick. The undertying material is very channery sandy
Ioam. Depth to hard calcareous sandstone ranges from
10 to 20 inches. Permeability is moderately rapid'
Available water capacity is very low. Effective
rooting depth is 10 to 20 inches. Runoff is medium to
rapid, and the hazard of water erosion is very high'
Rock outcrop is mainly red sandstone.
FTUVAQUENTS, O TO 10 PERCENT SLOPES This broadlv
defined unit consists of deep, somewhat poorly drained
soils on flood plains and alluvial valley floors'
Fluvaquents are stratified and vary widely in texture
and depth to sands, gravels and cobbles. The surface
layer 1s loamy sand to fine sandy loam and silty loam
to clay loam. The underlying layers are generally
sandy loam or loam stratified with sands, gravels, and
cobbles. In some areas, gtravels and cobbles are on or
near the surface. Permeability varies from rapid tc>
moderately slow. Available water capacity above the
water table is very low or low. Rooting depth is 60
inches or more for water tolerant plants. Runoff is
slow to medium. Erosion hazard is slight to high. The
water table fluctuates between depths of 0.5 and 2
feet, during spring and summer. These soils are
subject to brief, occasional flooding tate in spring
and early in summer.
MORVAL-TRIDELL COMPLEX, ].2 TO 5O PERCENT SLOPES ThESE
soils are on alluvial fans and sides of mesas. The
soils formed in reworked alluvium derived from basalt
and sandstone. The Morval Soil makes up about 55
percent of the unit, and the Tridell soil makes up
about 30 percent.

map unit is on upland benches, foot-slopes, and
al1uvial fans. The Southace soil is deep and
well-drained. It formed in alluvj-um derived dominantly
from redbed sandstone and shale intermixed with
gypsiferous material. The surface layer is cobbly
iii,ay loam 3 inches thick. The upper Lt inches of the
unaeitying material is gravelly loam. The next Lz
inches is very gravelly loam. The next 34 inches to a
a.pin of 60 inches or more is very cobbly fine sandy
10am. The amount of stones and cobbles increases with
depth. Permeability is moderate. Available water
caiacity is low. Eifective rooting depth is 60 inches
or more. Runoff is medium to rapid, and the hazard of
water erosion is moderate to high.
TORRIORTHENTS_CAMBORTHIDS_ROCK OUTCROP COMPLEX, 5 TO 65
PERCENT SLOPES This broadly defined unit consists of
exposed sandstone and shale bedrock, loose stones, and
soils that are shallow to deep over sandstone and shale

SLOPES, EXTREMELY STONY This map unit is on terrace andmountainside slopes. Thls unit is 45 percent Tridell
and 35 percent Brownsto. The surface is scattered with5 to 10 percent stones.

changes in the years I've lived here and many of them are diametricdly opposed to the rural liv-
ing which we all had hoped to keep in our smdl vdley. Not only the breaking up of a 5 acrc par-
cel but dso the situation of the proposed piece of land is very Disturbing. This land is on a very
Dangerous curve where the road narrows. There was tdk yea$ ago about the county widcning
the road at that precise point, but because of the historic barn and elegant trees that form a
canopy above the road the idea was tabled. The speed limit is reduced to 15 mph dong this
stretch which by the way pardlels this proposed subdivision. Its a very dangerous spot, with peo-
ple flying by at 30mph to 40mph regularly. I persondly know of 2 acridents in the last year and
have spoken to Garfield deputies about it. The hillside where Ms. McCreary plans to build a
house is extremely steep and on unpredictable terrain as we had a slide there a little over a.yar
ago. Also it should be noted that Shaeffer ditch runs through the proposed suMivision.

along the north side of County Road I l3 (Cattle Creek Road), approximately three (3) miles
east of State Highway 82. The applicant is proposing an exemption to split a 5.23 acreparcel

Dear Dave,
We are in receipt ol the subdivision exemption referra! for a 5.23 acre parcel located on the
north side of County Road 113, approximately three miles east of State Highway 82. The
applicant is proposing to split this parcel into two parcels ol2.O and 3.23 acres. An existing well,
permit no. 93284, appears to be located on this 5.23 acre parcel and is proposed as the water
supply for one ol the parcels. A new well is proposed for the other parce!.
The avaitability of a well permit for the new parcel is subject to the following conditions:
The Colorado River system and its tributaries at this Iocation are over-appropriated. As
such, well permits applications in new subdivisions must be evaluated to determine if other water
rights would be injured considering the cumulative etfect of all proposed wells. lt is likely that
in many circumstances well permits could not be issued by our office without a water court
approved plan for augmentation. However, under current statutes, if the Garfield Board of
County Commissioners approrres thls split by exennption as defined in Section 30-28-'!01(10Xd)
C.R.S., our otfice must evaluate the wel! permit applications as if the division of land occurred
prior to June 1 ,1972.
Under current laws, Section 37-92-602(3XbX!!XA) C.R.S., and hydrologic conditions, it
appears that our office could in this circumstance approve a well permit for ordinary household
purposes inside a single-family dwelling provided that the well would be the only well on the
individual parce!, return flow would be to the same stream system in which the well is located via
a non-evaporative disposa! system, and that evidence is submitted showing that the County has
approved the parcel as an exemption. Absolutely no outside uses, including irrigation and the
watering of animals, are allowed under this type of permit.
