HomeMy WebLinkAbout1.03 Community Development Dept completion of submittal noticeDecember 31, 2014 Garfield County Robyn Starr 0425 Mountain Shadows Dr. Glenwood Springs, CO 81601 RE: Starr ADU Administrative Review (File No. GAPA-8132) Dear Robyn: Community Development Department Your Application for an Administrative Land Use Change Permit for an Accessory Dwelling Unit (ADU) has been reviewed for completeness in accordance with the Garfield County Land Use and Development Code. The review has included your supplemental submittals. This letter is to advise you that that the application has been deemed technically complete and scheduled for a decision by the Director of the Community Development Department. Please understand that a determination of technical completeness shall not be viewed as a recommendation of approval, finding of an adequate application, or a finding of general compliance with any goal or objective of the Garfield County Land Use and Development Code or the Garfield County Comprehensive Plan 2030. The Application will be reviewed by Staff and a report will be sent to you. The date upon which the Director of the Community Development Department will render a decision has been set for January 30, 2015. Public notice at least 15 days prior to the Director's Decision is required by written notice by certified mail to the owners of record of all property adjacent to the property and within 200 ft. and by certified maillretum receipt requested to any mineral owners of record for the subject property. The Applicant shall be solely responsible for the mailing of the notice. The Applicant shall present proof of the required notice to the Community Development Department prior to the Director's Decision. Details regarding the notice requirements are found in the Land Use and Development Code in Table 4-102 and Sections 4-101(E) and 4-103(B). The notice shall include a vicinity map, the property's legal description, a short narrative describing the current zoning and proposed Land Use Change, the contact information for the Community Development Department and the date that the Director will make a decision. I have enclosed an appropriate notice form for the Director's Decision consistent with the code sections noted above. This document is provided to you as a courtesy. The Applicant must verify that all information in the document is correct and insert or attach the legal description and vicinity map. It shall be the obligation of the Applicant to correct any deficiencies in the document such that proper notice in form and substance can be established. Included for your convenience is the following outline of the process from this point. 1. Additional copies of the submittals should be provided by the Applicant by January 6111. The copies need to include the complete application including all supplemental information. Referrals will be sent out on January 61h with comments requested within 21 days. 2. Public Notice must be mailed by the Applicant 15 days prior to the date set for the Director's Decision (mailing no later than January 15th). The Applicant will provide the proof of mailing (mailing receipts and certified return receipts) and the attached public notice information form to the County prior to the Director's Decision. 3. Referral Comments are due back on January 27th at which time the Staff Report will be finalized. 4. On January 30th the Director of the Community Development Department will render a Decision to approve, approve with conditions or deny the application. 5. The Board of County Commissioners will be provided notice of the Director's decision and has 10 days to request a public hearing (call-up). 6. If the call-up time period expires without a request for a hearing, the Planner will proceed with verification of completion of any conditions of approval. 7. Once all conditions are met the Planner will prepare the Land Use Change Permit for execution by the Director. Please submit by January 6th, three additional hardcopies of your complete application and 8 additional copies on CD's. The site is just west of the Western Hilts Subdivision and just east of the Chalet Village Subdivision. The property is also known by Assessor's Parcel No. 2119-343-00-005. The Applicant is requesting approval for an Accessory Dwelling Unit on the approximately Y2 acre site. The Accessory Dwelling Unit is proposed to be 1,500 sq.ft. in size and will be served by central water and sewer systems. Access will be shared with the existing single family residence on the property and is directly off of Mountain Shadows Drive. The property is zoned Residential Urban (RU). The File No. is GAPA-8132.
