BZ-t Bt A RESOLUTION CONCERNED WITH GRANTING AN UXEMPTION FROM THE GARFIELD COI]NTY SUBDIVISION REGUI"ATIONS FOR JOHN AND GAIL MCDAID. WIIEREAS, John and GalL McDaid have petitloned the Board of County Co,mmissloners of Garfield County, Colorado, for an exenption from the definltlon of the ter:ms!'subdlvision" and'rsubdivLded land'r under C.R.S. 1973, 30-28-101 (a)-(d), as amended, and the SuMivision Regulations of Garfield County, Colorado, adopted January 2, L979, Sections 2.02.01 (d) and 3.02.01 for the division of a 49.6 acre tract described as foLlows: that pareel of land as described in Document No. 2767L0 as flLed in the Offlce of the Clerk and Recorder of Garfleld County, Colorado into 2 tracts of approximateLy 2 and 47,6 acres each, more or less, which proposed dlvided tract is more partleularl-y descrlbed as follows: TRACT A: Beginning at a fence corner io place whence the Northeast Corner of Section 6, Toronship 6 South, Range 92 West of the 6th Prlncipal. Mertdian, Garfteld County, Colorado, bears N.88"36100"8. 1265.00 feet; thence S.0"12t30"E, L25.00 feet along a fence Ilne in place; thence N.89'44t3OttE. 697 .00 feet; thence N.0o12t30"W. 125.00 feet to a point on the southerly rfight-of-way line of County Road No. 233, as establtshed by a fence Ltne in pJ-ace, to the point of beglnning. Containlng 2.000 acres, more or less. TRAGI B: The remalning 47.6 acres. (in the State of Colorado Cornty of Garf ield); andand IJHEREAS, the Petitloners have demonstrated to Corgrty Comissioners of Garfleld Cor-rnty, CoJ-orado, not faLl within the purposes of Part 1, Artlcle 28, Statutes, L973, as amended, for the reason that the purposes of leasj-ng and no new lots are created by the satisfaction of the Board of that the proposed divlslon does Tlt1e 30, Colorado Revised two acre tract ls soLely for the this actlon, and !ilHEREAS, the Petitloners have demonstrated to the satlsfactlon of the Board of County Commissioners of Garfield County, Colorado, that there Ls a reasonable probabllity of, locatl.ng domesti.c water on each of said tracts, that there ls adeqr:ate ingress and egress to sald tracts, that the locatlon of septic tanks will be pernitted by the Colorado Department of Health, that tire reQuested divlslon is not part of an existlng or larger development and does not fall wlthin the general purposes and lntent of the subdivlsion regul-atlons of the State of Col-orado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivlded Land" as 6et forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; NOW, THEREFoRE, BE IT RES0LVED that the dividion of the above described tracts "Att andttBt'from the above described 49.6 acre tract is hereby exempted from such definltions and saLd tract nay be divided into tracts t'Att and "Btt, all as ls more f,ully deseribed above, and said divided Lract may be conveyed ln the form of such smaller tracts without further compl-iance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption ls granted on the conditlon and with the express understanding and agreement of the Petitloners that thLs parcel ls created sole1y for the purposes of leasing, and this actlon by this Board does not constitute creatlon of a parcel for which ownershlp nay be transferred.
