EXEMPTION
APPLICABILITY
The Board of County Commissioners has the discretionary power to exempt a
division of lancl fiom the definiLion of subdivision and thereby from the
pio""aur" in these Regulations, provided the Board determines that, such
l*"*p[ion will not impair or defeal the stated purpose of the Subdivision
ieguiations nor be del.rimental to the general public welfare. The Board
shaIl make eiemption decisions in aicorclance with the requirements of
these regulations-. Following a review of Lhe individual facts of each
application in light of th; requirements of these Regulations, the Board
may approve, conditionally apProve or deny an exemption. An aPPlication
f;i eitlmpti6n must satiifyl at a minirnum, all of the review cr iteria
lisbed Le1ow. Compliance with the review criteriar however, does not
ensure exemption. the Board also may consider adclitonal factors listetl in
Section B:60 of the Subdivision Regulations.
A. No more than a total of four (4) lotsr Pdfcels, interests or dwelling
units will be created from any parcelr ai that parcel was described in
the records of the GarfiefO- County Clerk and Recorderts Office on
January 1, 1973, and is not a part of a recorded subdivision; however,
any parcel to be <livided UV exemption that is split b{-" Public
rigtrt-of-way (State or federal highway, County road or railroad) or
na[uraI feature, preventing joint use of the proposed tracts, and the
division occurs-aiong Ufre putrtic right-of-way or natural feature, such

any necessary access easemenLs have been obtained or are in the
process of being obtained; and
D. -provision has b6en made for an adequate source of water in terms of
both the legal and physical qualiti, quantity and dependabilityr ard a
suitable tyie of seirage disposal to serve each proposed lot; and
E. All state lnd 1ocal environmental health and safety requirements have
been met or are in the process of being met; and
F. ProVision has been macle f or any required road or storm drainage
improuements; andG. riie protection has been approved by t.he appropriate fire districb.
H. Any necessary drainage, irrigation or utility easements have been
ob[ained or aie in the process of being obtaiped; and
