PETITION FOR EXEMPTION
BEFORE THE BOARD OF COUNTY COMMISSIONERS
GARFIELD COUNTY, COLORADO
Pursuant to C.R.S. (1973) $30-28-101(10Xa)-(d), as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April23,l984, as amended September 7,1999,
gt',b0, Rotand Paul McKee and Pamela S. McKee, petition the Board of County Commissioners of
fuarfield County, Colorado to exempt by Resolution, the division of a forty acre tract of land into
fourtracts of six to twelve acres each from the definitions of "Subdivision" and "Subdivided Land,"
as the terms are used and defined in C.R.S. (1973) $30-23-101(1OXa)-(d), and the Garfield County
Subdivision Regulations for the reasons stated below.
1. The forty acre, more or less, tract which is the subject ofthis Petition is owned bythe
Petitioners, and is described as the NEYNW%, Section 30, Township 6 South, Range 93 West of
the 6ft P.IyI., Garfield County, Colorado, except that portion conveyed to Garfield County for road
purposes.
2. The parcels to be exempted are depicted with approximate boundaries on the Sketch
Map submitted herewith as Exhibit A.
3. The purpose of this exemption request is to allow residential sale and use of three of
the parcels to be eximfted. The remaining parcel is occupied by applicants' existing residence.
4. The residential improvements on three ofthe proposed parcels shall be supplied with
domestic well water from an exempt well to be permitted, drilled and completed. The fourth parcel
shall be served from existing tap on the City of Rifle, Beaver Creek water line.
5. Any improvements to be erected in the future on the parcels shall be served by
individual septic systems.
6. Access to two of the parcels to be exempted is directly from County Road 320.
Access to the other two parcels to be exempted is directly from County Road 317 (Beaver Creek
Road).
7. Copies of the applicants' deed and the ones by which their predecessors took title
before January t , igl 3 ( I 94 s *rough lgg2) ,are submitted herewith as Exhibit C , demonstrating the
tracts to be exempted as they exist presently, are forty acres owned as a unit as of January 1,1973.

This soil is used mainly for grazing, wildlife habitat, and
some dryland farming (fig. 10). Wheat, barley, and oats
are grown.
Minimum contour tillage and stubble mulching help to
prevent excessive erosion.
The native vegetation on this soil is mainly wheat-
grass, needleandthread, and sagebrush.
When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, undesira-ble weeds and annual plants are numerous. properly
managing grazing improves and maintains range cbnOi
tion. Reducing brush improves range. Seeding improves
range in poor condition. crested wheatgrass, western
wheatgrass, and Russian wildrye are suiiible for seed-
ing. Preparing a seedbed and drilling the seed are good
practices.' Community development and recreation are limitediil

formed in very strongly calcareous, basaltic alluvium and
small amounts of eolian material. The average annualprecipitation is about 14 inches, the average innual airtemperature is about 46 degrees F, and -the average
frost-free period is about 120 days.
The Potts soil makes up about 60 percent of the map
unit, and the lldefonso soils makes up about 30 perceni.
The Potts soil is on slighily concave positions, 'and the
lldefonso soil is on the breaks of steeper slopes.
The Potts soil is deep and well drained. typically, the

We reviewed Ehe Western Water Treatmentss proposal to treats Ehe Beaver Creek water. The
process appears to address Ehe issue of water "quality. n You are sti1l left withiquantityi and ',dependability". The Beaver Creek raw water supply can be interrupted
during dry years or during maintenance operations conducted by the City of Rifle. If the
Board of CounUy Commissioners feel cisterns offer a sufficient means of guaranteeing
domestic waEer, then it appears the McKee's have addressed the question of water.
The CiEy of Rifle sti1l emphasizes the McKee's are only permitUed to use up to 500 gpd
subject to Ehe conditions of the court decree.

The letter included in the application as Exhibit F was remitted to the Rifle Fire protection
District contemporaneously with the submittal of the application to you. We have contactedthe Rifle Fire Protection District on several occasions and requested that they remit the
response to you, with a copy to us.
Submitted herewith is a letter from the City of Rifle, together with a copy of the Decree
entered october 17,7906, which includes the stipulation providing for 5ti{i gallons of citywater (untreated) per day for domestic use to G.W. Taughenbaugh,it al. Also submitted isa copy of deed recorded in Book 67 at Page l6i of the Garfield County recordsdemonstrating that G.W. Taughenbaugh is the predecessor in ownership to the northeast
elartgr northwest quarter of Section 30, Township 6 South, Range 92 West of the 6th p.M.,
which is the property which is the subject of the application.
I am also including duplicate copies of a map prepared for the City of Rifle in 1993 concerning thebeneficiaries ofthe domestic water supply. t trave trighlighted the northeast quarter ofthe northwestquarter of Section 30, owned by McKee's immediate pr.d...rror in title, Specking, at the time themap was prepared.

Submitted herewith you will find the final plat of the above-referenced exemption, together with the
Applicants' check in the amount of $600 representing the school site acquisition fees for the three
lots to be newly created.
On the plat, you will find plat notes as provided under paragraph 10 of your letter of December 3,
2002.
The matters requested under paragraph 3 of your letter were provided prior to the hearing before the
County Commissioners. A final draft of the Water Well Agreement, executed by the Applicants,
is submitted herewith.
I am also submiuing an executed Declaration of Private Roadway Easement and Maintenance
Obligations as required under paragraph 8 of your letter.
Finally, enclosed you will find a Right-of-Way Deed from the Applicants to the County covering the
two County Road rights-of-way depicted on the final plat. This should be recorded subsequent to
the filing of the plat and, the reception number for the plat should be inserted in the text of the
description set forth in the Right-of-Way Deed.

My clients are well aware of the corespondence which has been exchanged between the City of
Rifle and the Colorado Department of Public Health and Environment. From recent conversations
I have had with City Attorney Leavenworth, it is my understanding that the position of the City
remains as stated in his letter ofNovember 28,2002. It is consistent with the Applicants' position
that the supply from the City of Rifle is pursuant to a decree of the District Court, which may not
circumvented or nullified by a health department regulation or directive. It is clear that the property
owners are entitled to delivery of water. Whether the City will be required by the State to find the
means of treating the water prior to its delivery is not a major concem to the McKees, as they have
already provided for treatment of all household water supplied via the City's Beaver Creek line.
Based on the foregoing, we request that the Commission now approve and execute the final plat.
Upon approval by the County Commissioners, please advise me of the amount of check required for
recording the various documents and I will promptly provide it to you.

Dear Water Line Users:
We represent the City of Rifle. As you know, the Colorado Departrnent of Public Health
and Environment ("CDpHE") cited the City of Rifle for a violation of a Water auahty Control
Division policy prohibiting water taps onto untreated water lines, such as the city's Beaver-creek
Raw water Line. In early December, the city informedyou of the violation letter from GDPHE
and provided you this office's response

The city received a letter dated october 2l,2ooz from the Colorado Deparftnent ofPublic Health and Environment stating the results of a recent inspection of the city,s waterfacilities' The first item in that letterielated to the various users of the Beaver creek waterLine and a water Quality control Division Policy prohibiting individual,.p, to-* *';;;;,mains' we have enclosed the Policy and a

li a case sent to us by the state. In essence,the State is requiring the City to disconnect the individual users from the water Line.
- As many of you know, your entitlement to water from the City,s Water Line isformalized in a Findings and Decree in Civil Action No. tzos o.rJ-6.r"i.riz, 1906. Wehave enclosed the Decree. As you can see in the city's reply letter to the State that is also
