petitioned the Board of
for an exemption under C.R.S.
and the Subdivision
September 1, 1972 and amended
for the division of a 4.251
acre parcel of land into tr^ro parcels of 1.964 and 2.287 acres, rrnre or
and said parcels are rnre particularly described as follows:
Beginning on the east line of the SI&NEL at a point
127.9 feet south of the NE Corner SWANEk whence
the NE Corner Section 18 bears N. 420 t3'E. 1964.8feet; 1. Thence along a curve to the left with a
radius of 851.5 feet a distance of 240.7 feet, the
chord of which arc bears N. 78o 20' 30" t'l. 239.9feet; 2. Thence South 382.6 feet; 3. Thence East
235.0 feet to the east line SWl"oNEk Section 18; 4.
Thence along the east line of St'l%SEk North 334.1 feet,' more or less, to the place of beginning.

IIHEREASn the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, CoIorado, that they desire said
exenption .for the purpose of re-sale into single-family residential acreagei
and,

HHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
dorBstic water on each of said tracts, that there is adequate ingress and egress
to sald tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance with
the general purposes and intent of the Subdivision Regulations of the State of
Colorado and the County of Garfield and should, therefore, be exempted from the
definition of the terms "subdivision" and "subdivided Iandn as set forth in
C.R.S. (I973) Section 30-28-l0I (tO1 (a) - (d) as anendedi
ll0l,, THEREFORE, upon motion of R.0 .Jottal seconded by

hereby exempted from such definition and transfer of said tract may be made by
division into two tracts of 2.297 and I.964 acres, IIDre or less, and said
exemption is conditioned upon the following:
(I) Obtaining, within sixty (60) days of this
Resolution, a variance from minimum lot size
of two acres on the 1.964 acre tract, from
the-Garfield County Zoning Board of
Adjustment; and
(2) Providing, within sixty (00) aays of this
Resolution, the necessary upgrading of the
individual sewage disposal system on the
1.964 acre tract to allow at least .1500
gallons of septic tank capacity.
, In tlre event any of the above conditions are not so met as stated, then
the exemption granted hereby shall be void and of no effect. A copy of the
instrurent(s) of conveyance when recorded shall be fi'led with this Resolution.
