(1973) Section 30- 28-l0l (lO) (a) - (d) andthe Garfield County Subdivision Regulations for the reasons stated below: see attached statement SI.JBMITTAL REQUIREMENTS : An application which satisfied the review criteria must be zubmitted with all the following information: A. Sketch map at a minimum scale of l"=200'showing the legal desoiption of the property, dimension and area of all lots or separate interests to be created, access to ap.ublic right-of-way, and any proposed easements for drainage, inigatioq access or utilities; and B. Vicinity map at a minimum scale of ln=2000' showing the general topographic and geognphic relation ofthe proposed orempion to the surrounding area within two (2) miles, forwhich a copy of U.S.G.S. quadrangle map may be used; and C. Copy ofthe deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and D. Names and addresses of owners of record of land immediately adjoining and within 200 feet ofthe proposed exemptioq mineral owners and lessees of minerals owners ofrecord ofthe property to be orernpted, and tenants of any structure proposed for conversion; and E. Evidence ofthe soil types and characteristics of each type; and F. Proof oflegal and adequate sour@ ofdomestic water for each lot created, method of sewage disposal, and letter of approval of fire protection plan from appropriate fire . district; and G. Ifconnection to a community or nnmicipal water or sewer system is proposed, a letter fiom the governing body stating awillingness to serve; and H. Narrative explaining why oremption is being requested; and 1. It shall be demonstrated that the parcd oristed as described on January l, 1973 or the parcel as it orists presentty is one ofnot moretban tlree parcels created from a larger J. parcel as it oristed on lanuary 1,1973. A $300.00 fee must be srbmitted with the application.4 0534 County Road 100 Ir/failing Address Carbondale co 8L623 City 963-9496 TelephoneNumber E)(EMPTION APPLICABILITY fire Board ofCorrty Commissioners has the discretionary power to o(empt a division of land from the definition of srbdivision and ther$y from the procedre inthese Regulations, provided the Board determines that such oremption will not impair or defeat the stated purpose of the Subdivision Regulations nor be detrimental to the general prblic welfare. The Board shall make oremption decisions in accordance with the requirernents of these regulations. Following a review of the individual frcts of each application in light ofthe requirenrents ofthese Regulations, the Board may approve, conditionally approve or deny an orernption. An application for oremption nrust satit'y, at a minimum, all of the review criteria listed below. Compliance with the rwiew criteri4 howwer, does not ensure ocemption. The Board also may consider additional factors listed in Sestion 8:60 of the Subdivision Regulations. A No more than a total of four (4) lots, parcels, interests or dwelling units witl be created ftom any parcel, as that parcel was described in the records of the Garfield County Clerk and RecordeCs Office on January l,1973. In order to qualify for oremptiorL the parcel as it oristed on January l,1973, must have been 35 acres or greater in size at that time and not a part of a recorded zubdivision; howwer, any parcel to be divided by oremption that is split by a public riglrt-of-way (State or Federal highway, County road or railroad), prwedting joint use ofthe proposed tracts, and the division occurs along the public rigtrt-of- way, such parcels thereby created may, at the discretion of the Board, not be considered to havebeen creatd by oremption with regani to the four (4) lot, parcel, interest or dwelling ttttit limitation ottrenrrise applicable. For the purposes of definition, all trasts of land 35 acres or greater in sizg creatd after January l, 1973 will count as parcels of land creatd by orunption since Ianuary l,lg73. State l. Applicant requests the exemption from subdivision of a2 acre parcel to be created fr9m applicant's property located approximately one-half mile easterly ofthe Town of Carbondale and known as 0481 County Road 100 and described in Deed referred to in item C above (hereinafter the "fathering parcel"). Certain real property (hereinafter referred to as the "parent parcel') was acquired by John F. Nieslanik, Jr., Paul R. Nieslanik and Robert R. Nieslanik, dlblaNieslanik Brothers by Deed dated May 2,1969 and recorded in Book 401 atPage 435 of the Garfield County records. During the Nieslanik Brothers' ownership of the parent parcel, a parcel containing approximately 2.00 acres was donated to the Archdiocese of Denver for the benefit of St. Mary's of the crown Catholic Church by Deed dated February 15, l97g and recorded in Book 506 at Page223 of said records. The entire remainder ofthe parent parcel was distributed and conveyed to Paul R. Nieslanik and Celia R. Nieslanik (hereinafter "Paul and celia") by Special wananty Deed dated June 17, l99l recorded in Book 842 atPage 326 of the Garfield County records. Colorado Ute Electric Association acquired a 19.288 acre parcel from the parent parcel by Court Order dated August 23, 1979 recorded in Book 533 at Page TZL Paul and Celia conveyed a parcel containing more than 35 acres to their son and the applicant herein, Timothy M. Nieslanik, by Deed dated September 22,lg92and recorded in Book 842 at Page 322. The applicant received from Mid-Continent Resources, Inc., a QuitClaim Deed dated June 2, 1994 recorded in Book 905 at page 347 conveying to applicant a .669 acre parcel to resolve a boundary issue between the applicant's properly andthe adjoining property ofMid-ContinentResources,Inc. Paul and Celia and the applicant entered into Correction Deeds dated August 12, 1994 recorded in !9ok 913 at Page 406 and dated February l, 2000 recorded in Book I l7l at page 765, in order to correct boundary lines and incorporate the Mid-Continent parcel into the fathering parcel of applicant which is the subject of this Petition. The applicant constucted a residence on the 2 acre parce I in 1992. 'Ihe 2acre parcel is located adjacentto County Road 100 and is physilaty isolated from the remainderof applicant's property by steep terrain. -In addition to the above referenced information, the applicant submits the following in further support ofthis petition: 1' All Garfield County zoning requirements will be met with respect to the 2 acre parcel. 2' The two lots to be created will have legal access to a public right-of-way. 3 ' T\e 2acre parcel has an adequate legal and physical source of water as above provided. 4' The parcel is served by an existing septic system installed pursuant to County Regulations. 5' All state and local environmental health and safety requirements have been' met. 6. No road or storm drainage improvements are required. 7 ' Fire protection has been approved by the Carbondale Rural Fire protection District as above provided. 8' All necessary drainage, irrigation and utility easements are in existence. 9' School fees, ta:res and special assessments have been paid or are paid concurrently with this application. The three Nieslanik brothers, John, Paul and Bob acquired the parent parcel in1969. Nieslanik Brothers dissolved their partnership in I 991 which resulted in each brother and their respective spouse receiving, in its entirety, one of the three ranches previously owned and operated by the Nieslanik Brothers. Paul and Celia rebeived the ranch which the parent parcel in this matter. Paul and Celia gifted from the parent parcel a parcel of more than 35 acres to their son Tim in 1992. Mid-Continent Resources in 1994 to resolve a parcel was incorporated in and made a part of Paul and Celia have previously used 2 of the subdivision exemptions available with respect to the parent parcel by virtue of a donation of a parcel to the St. Mary,s of the Crown Catholic Church in 1978 (which parcel was expanded by a boundary line adjustment in 1999) and by the conveyance to Tim of what is now the 37.102 acre parcel referred to as the "fathering parcel" in the petition for Exemption.
