Clerk of the Board Ed Crreen County Administrator when the following prooeedings, among others were had and done, to-wit: RESOLUTION NO. 2OOO.57 A RESOLUTION CONCERNBD WITTI GRAT..TTING A}I E)GMPTION FROM TTIE GARFIELD COTJNTY SUBDIVISION REGULATIONS FOR TIMOTHY M. NIESLA}.IIK. WI{EREAS, Timothy M. Nieslanik petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms ,,subdivision,, and "subdivided land" under C.R.S. 1973,30-28-l0l (10) (a)-(d), as amended, and the SuMivision Regulations of Garfield County Colorado, adopted April 23, 1984, Section 8:00through 8:60 and for the division of a 37.102 acre tract as described in Book ll7l, Page 765, as filed in the Offices of the Clerk and Recorder of Garfield County, Colorado, into trvo (2) tracts of approximately 2.0, and 35.102 acres each with the exemption parcels more practically as follows: Lot I Lot2 See Attached - Resultott Fathering Parcel See Attached - Exemption Pucel (in the State of Colorado and the Couner of Garfield); and WHEREAS, the Petifioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed dMsion does not falt within thl purposes of Part l, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the division does not warant further subdivision review; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said parcelq that thtre is existing ingress and Lgress to said parcel{ that the location of septio tanks will be permitted by the Colorado Department of Healtlr, itrat the requested dMsion is not part of an existing or larger development and does not ftll within the I ilil ililr illl lllll llll lllll lllllll lll llil llll llll SglfSa OUOAI2W\ 10:364 E.IZ;OO ne78 f RLSERF 2 ol 3 R O.OO O O.OO GRRFIELD C0UNTY C0 general purposes and intent of the Subdivision Regulations of the State of and the County of Garfield, and should, thereforq be exempted from the definition "subdivision" and "subdivided land" as set forth in C.R.S. 1973. 30-28-l0l (10 amended; and NOW THEREFORE, BE IT RESOLVED that the division of the above 37.t02 acre parcel is hereby exemptd from such definitions and may be conveyed in the of the Lot "l' and Lot '?u, as are more fully described above and that a copy of the instruments of conveyance when recorded shall be fild with tlris Resolution.
