BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17(d) and 3.02.01, the undersigned Arthur J. Moscon
and Thelma Moscon respectfully petitions the Board of County
Commissioners of Garfield County, Colorado, to exempt by
resolution the division of the tract of land depicted on the
attached plat, from the definitions of "subdivision" and
"subdivision land" as the terms are used and defined in C.R.S.
(1973) Section 30 -28 -101(a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
1. Petitioners are the owners in joint tenancy
of a tract of land containing 3.5 acres, more or less, and
depicted on the attached plat by the dotted lines.
2. Petitioners reside in a residence located on
the tract of land containing 3.5 acres, which residence was
constructed in 1908. The water servicing said house is
obtained from the West Glenwood Springs Water District and
the sewage services are provided by the West Glenwood Springs
Sanitation District. Access is obtained from County
Road 130.
3. Petitioners desire to convey to Peter J. Moscon
and Mary L. Moscon a tract of land containing .45 of an acre
depicted on the attached plat and more particularly described
on the attached plat.

4. Peter J. Moscon and Mary L. Moscon have resided
in a residence on the tract containing .45 acres continuously
since January 1, 1973. All utilities serving said residence
are derived from the same entities which serve the
residence occupied by the petitioners. Access is obtained
directly from County Road 130.

A parcel of land situated in Lot 4 of Section 5, Township 6 South, Range 89 West of the
Sixth Principal Meridian, County of Garfield, State of Colorado, lying Southwesterly of
the Southwesterly right-of-way fence of County Road No. 130, said parcel of land is des-
cribed as follows:
Beginning at a point on said right-of-way fence whence an iron post with a brass cap found
in place and properly marked for the Southeast Corner of Section 34 in Township 5 South,
4 Range 89 West of the Sixth Princiapl Meridian bears: N.60°04'20" E. 417.99 feet; thence
S.19°18'30" W. 231.21 feet; thence N.59°33'00" W. 43.04 feet; thence N.01°44'00" E. 273.23

said right-of-way fence, 130.27 feet to the point of beginning, containing 0.45 acres,
