RESOLUTION
WHEREAS, Arthur J. Moscon and Thelma Moscon have
petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption under C.R.S. 1973, 30-28-
101(a) of the Garfield County Subdivision regulations, as
amended, and
WHEREAS, the Board finds that the division of the
tract of land located in Lot 4 of Section 5, Township 6
South, Range 89 West of the 6th P.M. into two parcels of
land as depicted on the plat attached hereto as Exhibit "A"
and by this reference made
for the purpose of evading
resolutions pertaining to
the same should be exempt
a part hereof, will not be made
State and County statutes and
the subdivision of land and that
from the definition of the term
"subdivision" and "subdivided land" and from regulation
under the Garfield County Subdivision Regulations, as amended.

NOW, THEREFORE upon Motion of
seconded by ` , L. ! (_. L t and unanimously

carried, the division of the tract of land above referred to
into the tracts of land more particularly depicted on the
plat attached hereto as Exhibit "A" is hereby exempt from
the definition of "subdivision" and "subdivided land" and
from regulation under the Garfield County Subdivision Regulations
and that the property may be divided into two parcels as
depicted on Exhibit "A" hereof.

A parcel of land situated in Lot 4 of Section 5, Township 6 South, Range 89 West of the
Sixth Principal Meridian, County of Garfield, State of Colorado, lying Southwesterly of
the Southwesterly right-of-way fence of County Road No. 130, said parcel of land is des-
cribed as follows: •
Beginning at a point on said right-of-way fence whence an iron post with a brass cap found
in place and properly marked for the Southeast Corner of Section 34 in Township 5 South,
Range 89 West of the Sixth Princiapl Meridian bears: N.60°04'20" E. 417.99 feet; thence
S.19°18'30" W. 231.21 feet; thence N.59°33'00" W. 43.04 feet; thence N.01°44'00" E. 27.3.23
feet, more or less to a point on said right-of-way fence; thence S.53°55'24" E. along
said right-of-way fence, 130.27 feet to the point of beginning, containing 0.45 acres,
more or less.
