To split a 35 acre tract into 2 parcels of 17 acres each ZONING: A/R/RD QUALIFICATIONS: Owned 5+ years; split by creek and road WATER: See staff comments SEWER: Individual septic ACCESS: Proposed 30 foot easement from County Road 241. COMPREHENSIVE PLAN: These properties lie within the designated floodplain and the New Castle Urban Area of Influence of the County Management Districts Plan map. STAFF COMMENTS: 1. Although this request is for a two lot split, the natural features involved would actually create the potential of three new lots. (See theoretical" drawing below). The applicant is requesting to subdivide the property along the creekline. This would create Parcel A, to the west of the creek; and Parcel B to the ease of the creek. However, Parcel B potentially includes two tracts: tract #1 which is east of the creek, and west of the county road; and tract #2, east of the county road. 2. The major concern is that the well permit that the applicant proposes to use could serve only one parcel. This is a "domestic" well permit which has specifically been limited to the service of only one single-family dwelling. (See attached permit, pages 7 & 8). The applicant has suggested that they will serve the additional new lot(s) with a cistern. However, the Board has indicated that they will not approve any new lots to be served by cisterns. The Board has indicated that they WILL approve storage tanks filled by springs on the property. However, the applicant has no water rights on the land. RECOMMENDATION: Denial, due to the inability to serve each resulting parcel with water. Page 5 Application must be complete where applicable. Type or print in BLACK INK.
