BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLORADO
REQUEST FOR SKETCH REVIEW AND EXEMPTION
Pursuant to 1973 C.R.S. 38-28-101 and the Garfield
County Subdivision Regulations, DONALD L. MC BEE and JANIS R. MC B
by their attorneys, Stuver and George, respectfully submit the
attached sketch plan of a proposed division of property located
in Garfield County which would result in the creation of two
tracts of land, one of which would be less than 35 acres in area,
and petitions the Board to except the partition of these tracts
from the provisions of the Garfield County Subdivision regulations
pertaining to subdivisions.
In support of this request the Petitioners state as
follows:
1. The Petitioners are the contract owners of the
35.71 acres situate in the NES, Section 24, Township 5 South,
Range 91 West of the 6th P.M., Garfield County, designated
Parcel No. 5 on Exhibit "A" hereto attached
2. It is the intention of the Petitioners to sell that
ortion of said parcel designated in yellow on said Exhibit "A"
to Jack Faris, the present owner in fee of the 1.24 acre parcel
designated in green on said Exhibit "A". If sold, the "yellow"
arcel would be used in conjunction with the "green" parcel.
3. The Petitioners are unable to proceed with the
partition and sale of the "yellow" parcel without the permission
of the Board.
4. The "yel-low" parcel is believed to comprise less
than one-half acre.
5. Access to the "yellow" parcel is directly onto
bounty Road No. 241 as is apparent from the attached Exhibit "A".
access to the "green" parcel presently owned by Faris would be
enhanced by acquisition of the "yellow" parcel.
6. The property to be sold by the Petitioners is served
by private well and sewage disposal system for the single-family
residence situate on the Faris property. No additional residence
or utilities are proposed.
7. Should the Petitioners ever wish to further divide
the remaining property in the NE4 of Section 24, Township 5 South,
ange 91 West of the 6th P.M. permission of the County Commissioner
would be required.
8. Current zoning of the subject property is A/R.
9. A copy of the deed of conveyance with survey descrip-
tion will be filed with this request and the Resolution of
Exemption if granted.
