RESOLUTION
WHEREAS, DONALD L. and JANIS R. MC BEE have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973)
Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975
Sections 1.02.17 (d) and 3.02.01, for the division of a 35.71 acre tract of
land into two tracts of .49 acre and 35.22 acres, more or less, and more
particularly described as follows:
That part of the ANE' of Section 24, Township 5 South,
Range 91 West of the 6th P.M., described as follows:
Beginning at a point on the East line of the SW4NE4
from whence the Northeast Corner of said Section 24,
Township 5 South, Range 91 West, of the 6th P.M.,
bears North 39° 57' 18" East 2025.38 feet; thence
North 89° 53' 50" West 939.91 feet more or less to a
point in the center of East Elk Creek; thence North
20° 12' 01" East 120.08 feet to a point in the center
of East Elk Creek; thence North 32° 22' 37" East
114.70 feet to A point in the center of East Elk Creek;
thence North 22' 38' 00" East 81.38 feet to a point
in the center of East Elk Creek; thence North 64°
11' 54" West 273.00 feet; thence South 28° 20' 06"
West 315.01 feet; thence South 890 01' 38" West 139.21
feet more or less to the Southwest corner of the
NW1NE4 of said Section 24; thence North 000 02' 18" West
1320.81 feet to the Northwest Corner of the Nh14NE4 of
said Section 24; thence North 880 48' 57" East 508.30
feet along the Northerly line of the NW4NE4 of said
Section 24; thence South 320 09' 08" West 81.30 feet;
thence South 05° 29' 43" West 312.5 feet; thence South
84° 04' 31" East 268.21 feet to the center of East Elk
Creek; thence North 82° 58' 07" East 523.90 feet more
or less to the East line of the NW1/4NE1 of said Section
24; thence South 000 13' 50" East 1165.55 feet to the
point of beginning.
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
that said exemption request is for the purpose of adding to an existing,
adjoining lot of record and that no third -party ownership will be created by
the exemption; and,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
that the requested division is in accordance with the general purposes and
intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield and should, therefore, be exempted from the definition of the
terms "subdivision" and "subdivision land" as set forth in C.R.S. (1973)
Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of 17k9v /- l`( ✓/ SC' seconded by

exempted from such definition and transfer of said tract may be made by
division into two tracts of land .49 acre and 35.22 acres, more or less, and
further that a proper legal description of the .49 acre parcel be prepared
prior to conveyance of said parcel, and further that this exemption will not
create a third -party ownership and will be added to an existing adjoining
lot of record. A copy of the instrument or instruments of conveyance when
recorded shall be filed with this Resolution.
