DEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO

WHEREAS, Charles W. Baker, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Sectionc
30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections
1.02.17(d) and 3.02.01, for the division of a 59.41 acre tract into three (3)
tracts of approximately 29, 15.41 and 15 acres, more or less, with said 59.41
acre tract more particularly described as follows:
A parcel of land situated in the SZSW' of Section 23, in
the N1/2NW4 of Section 26 all in Township 7 South, Range 92
West of the Sixth Principal Meridian, County of Grafield,
State of Colorado, lying Westerly of the Westerly right-
of-way fence of a County Road as constructed and in place
and Northerly of a fence as constructed and in place, said
parcel of land is described as follows:
Beginning at a point whence a rock corner found in place
and properly marked for the Southwest Corne, of said Section
26 bears: S09°47'12" West 5304.86 feet; thence S80°34'46"
East 523.56 feet; thence S87003'42" East 184.49 feet; thence
N64°02'26" East 99.84 feet; thence N46°04'58" East 35.07 feet;
thence N.32°50'33" East 163.46 feet to a point in Vhe center
of a lane as constructed and in place; thence N.89 23'15"
East 815.85 feet along the center of said lane, to a point
on the Westerly right-of-way fence of a County Road as constructed
and in palce; thence S.00°54'08" West 1309.25 feet along said
right-of-way fence; thence S.43°56'46" West 28.55 feet to a
point on a fence as constructed and in place; thence S.89008'
22" West 2404.02 feet along said fence; thence N.30°08'19" East
1441.67 feet, more or less to the point of beginning.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that there is a reasonable
probability of locating domestic water on each of said tracts, that there is
adequate ingress and egress to said tracts, that the location of septic tanks
will be permitted by the Colorado Department of Health, that the requested division
is in accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield, and should therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. (1973) Section 30-28-101 (10)(a) -(d) as amended;
NOW THEREFORE, upon motion of , C , JON , seconded by

exempted from such definition and transfer of said tract may be made by division

fully described in the Petition pertaining hereto, and further that said
exemption is conditioned upon the Petitioner obtaining a proper legal description
of said tracts prior to their conveyance. This exemption is granted upon the
condition that no further exemptions be allowed on said tracts of land. A
copy of the instruments of conveyance when recorded shall be filed with this
Resolution.
