Rhodes , County Attorney Leanne Cleland , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81-361 A RESOLUTION CONCERNED WITH THE APPROVAL OF THE PRELIMINARY FLAT SUBMITTAL FOR RIFLE CREEK ESTATES FILING 12. WHEREAS, Thomas Emmer has filed an application with the Planning Department of Garfield County for the approval of a Preliminary Plat in the Agricultural Residential Rural Density-A/R/RD Zone District, and WHEREAS, based on the material submitted by the applicant and the comments of the Garfield County Planning Department, this Board finds as follows: 1. That the Preliminary Plat conforms to Section 4.02 Preliminary Plat Requirements of the Garfield County Zoning Resolutions. 2. That the Preliminary Plat conforms to the requirements of the zone district which the development is in. 3. That for the above -stated and other reasons, the proposed Preliminary Plat appears to qualify for approval by this Board. NOW, THEREFORE, BE IS RESOLVED that the Preliminary Plat of Rifle Creek Estates Filing #2 for the following described unincorporated area of Garfield County be approved. A parcel of land situated in the SE4 SE4 of Section 24, T5S, R93,;', of the 6th P.M., lying Northerly of the Northerly boundary line of Rifle Creek Estates as on file in the office of the Clerk and Recorder of Garfield County, Colorado, as Document No. 300096. Said paicei being more particularly described as follows: Commencing at the reference monument for the Southeast Corner of said Section 24, a brass cap in place and marked as a Witness Corner to said Southeast Corner said monument being accepted as a reference monument in a dependent resurvey and survey of said Township 5 South, Range 93 West of the Sixth Principal Meridian by the U. S. Department of the Interior Bureau of Land Management dated January 20, 1978; thence S.00°10'00"E. 219.80 feet to the true position of the Southeast Corner of said Section 24, the True Point of Beginning; thence S.89°22'24"W. 1334.73 feet along the South line of said Section 24 to the Southwest Corner of said SE4 SE1, a brass cap found in place; thence leaving said south line N.00°11'22"W. 1326.66 feet along the westerly line of said SE1 SE1 to the Northwest Corner of said SE4 SE4: thence leaving said westerly line N.89°25'48"E. 1338.62 feet along the northerly line of said SE4 SE4 to the Northeast Corner of said SE4 SE4; thence leaving said northerly line along the easterly line of said Section 24 S.00°01'14"E. 1325.37 feet to the True Point of Beginning. Said parcel containing 40.68 acres, more or less. AND.BE IT FURTHER RESOLVED that the following conditions shall be placed upon this approval: 1. That there be a 10 foot utility easement along all lot lines. 2. That two wells be used to supply water to the water system; ie , an additional well must be drilled. 3. That Mesa Drive be surfaced with an asphalt mat and otherwise meet County Road standards. 4. That building envelopes be designated on lots #13, 14, and 15 and site specific soils analysis be performed on those lots by final plat. 5.
