The above entitled application was filed on November 29, 1984, and was
referred to the undersigned as [ater Referee for I'later Division No. 5' State
of Colorado, by the l,later Judge of said Court on the 17th day of December'
1984, in accordance with Article 9? of Chapter 37, Colorado Revised Statutes
1973, known as The I'later Right Determination and Administration Act of 1969.
And the undersigned Referee having made such investigations as are
necessary to determine whether or not the statements in the application
true and having become fully advised with respect to the subject matter
the application does hereby make the following determination and ruling
the Referee in this matter, to-wit:
l. The statements in the application are true.
2. The name of the structure is hlaters Well.
3. The name of the claimant and address is: Kathleen J. McVey; P. 0 Box
2492; Glenwood Springs, Colorado
4. The source of the water is a well having a depth of 83 feet, and
being tributary to Spring Val'ley, tributary to the Roaring Fork River.

East of the l,lest line of said Section 28.

6. 0n November 28, 1980, in Case No. 80CW240, the water Referee for
Water Division No. 5 awarded to Waters I'lell, a conditional water right for
- 0.055 cubic foot of water per second of time, to be used for domestic and
irrigation purposes with appropriation date of December 31, 1967. The
claimant was directed to file an Application For Quadrennial Finding of
Reasonable Diligence in the development of thfs conditional water right in
November of 1984 to maintain said conditional water right in full force and
effect. This Ruling of Referee was confirmed and made a Decree of the Court
on December 29, 1980.

7. 0n November 29, 1984, the claimant filed, in Water Court for lrlater
Division No. 5, as Application To Make Absolute a Conditional Water Right in
which it is requested that the 0.055 cubic foot of water per second of time
previously awarded conditionally to l,laters l{elI be made absolute and
unconditional.
In support of this request it is stated that construction has started
on a residence which will be completed in February, 1985. The water will be
put to beneficial use at that time
The Referee does therefore conclude that the above-entitled application
should be granted and that the 0.055 cubic foot of water per second of time
previously awarded conditionally to }laters l,IelI in Case No. 80C11240, with
Appropriation date of December 31,1967, be made absolute and unconditional.
It is accordingly 0RDERED that this ruling shall be filed with the llater
Clerk subject to judicial review.
It is further 0RDERED that a copy of this ruling shall be filed with the
appropriate Division Engineer and the State Engineer.

64 JERRY LOAM, 25 TO 65 PERCENT STOPES ThiS dEEP,
well-drained soil is on mountainsides. This soil
formed in alluvium derived from sandstone, shale, and
basalt. The surface layer is stony loam about 3 inches
thick. The subsoil is cobbly clay loam about 37 inches
thick. The substratum is cobbty clay to a depth of 60
inches. Permeability is slow, and available water
capacity is moderate. Effective rooting depth is 60
inches or more. Surface runoff is rapld, and the
erosion hazard is very high.
SHOWATTER-MORVAt COMPLEX, 15 TO 25 PERCENT SLOPES ThiS
map unit is on alluvia} fans, high terraces, and valley
sides. This unit is 45 percent Showalter very stony
loam and 35 percent Morval loam.
The Showalter soil is deep and well-drained. It formed
in alluvium derived dominantly from basalt. The
surface is covered with 10 to 15 percent stones, 5
percent cobble, and 5 percent gravel. The surface
layer is very stony loam 8 inches thlck. The upPer 3
inches of the subsoil is very cobbly clay loam. The
lower 28 inches of the subsoil is very cobbly clay.
The substratum to a depth of 60 inches or more is very
cobbly clay loam. Permeability is slow. Available
water-capacity is moderate. Effective rooting depth is
50 inches or more. Runoff is rapid, and the hazard of
water erosion is high to verY high.
The Morval soil is deep and well-drained. It formed in
alluvium derived dominantly from basalt. The surface
layer is loam 7 inches thick. The upper L2 inches of
the subsoil is clay loam. The lower 4 inches is loam.
The substratum to a depth of 60 inches or more is loam.
Permeability is moderate. Available water capacity is
moderate. Effective rooting depth is 60 inches or
more. Runoff is rapid, and the hazard of water erosion
is very hiqh.

Dear Dave:
Thank you lor the referral for the above referenced subdivision exemption located
approxlmately I miles south and east of Glenwood Springs. The applicant proposes to split a
10 acre parcel into two parcels of approximately 5 acres each. The proposed water supply for
this development appears to be an existing well, permit no,11?247, This well is identified as the
Waters Well in Division 5 Water Court case no.,84CW377.
The Waters Well was awarded 0.055 CFS (25 gpm) absolute for domestic and irrigation
purposes in case no. 84CW377 onMay 7,1985. The use of this well is limited to the historic use
as decreed in case no. 84CW377. Use of this well cannot be expanded to serve any additional
dwellings. A new household use well permit may be available for the second parcel subject to
the following conditions:
The Colorado River system and its tributaries at this location are over-appropriated. As
such, wel! permits applications in new subdivisions must be evaluated to determine if other water
rights would be injured considering the cumulative etfect of al! proposed wells. lt is likely that
in many circumstances well permits could not be issued by our office without a water court
approved plan for augmentation. However, under current statutes, if the Garfield Board of
County Commissioners approves this split by exemption as defined in Section 30-28-101(10Xd)
C.R.S,, our office must evaluate the well permit applications as if the division of land occurred
prior to June 1 ,1972.
Under current laws, Section 37-92-602(SXbXllXA) C.R.S., and hydrologic conditions, it
appears that our office could in this circumstance approve a well permit for ordinary household
purposes inside one slngle-family dwelling provided that the well would be the only well on the
individua! parcel, return flows would be to the same stream system in which the well is located
via a non-evaporative disposal system, and that evidence is submitted showing that the County
has approved the parcel as an exemption. Absolutely no outside uses, including inigation and
the watering of animals, are allowed under this type of permit.

Dear Kathleen:
On January 16th, 1995 the Board of County Commissioners approved your request for a
subdivision exemption, based on compliance with the following conditions:
All representations of the applicant shall be considered conditions of approval
unless otherwise stated by the applicant.
The applicant shall have 120 days to complete the required conditions of
approval. Extensions of 120 days may be granted by the Board for a period of
up to one (l) year.
The applicant shall submit $200 in School knpact Fees, prior to the signing of
an exemption plat.
A final exemption plat will be submitted, indicating the legal description of the
property, dimension and area of all proposed lots or separate interests to be
created, acoess to a public rigfrt-of-way, and any proposed easements for
drainage, irrigation, access and utilities. If a shared well is used, an
access/repair/maintenance easement of at least twenty (20) feet square around
the well and ten (10) feet wide around the waterline shall be shown on the plat.
A driveway permit, if necessary, shall be obtained from the Road and Bridge
Department prior to signing of a final plat.
Control of noxious weeds is the responsibility of the property owner.
USFS Wildfire Protection Guidelines shall be followed for all structures.
