RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District B - SubdivisionVRural Serviceable Areas - Category la - Areas within one mile of subdivisions with central water and sewer; Minor Environmental Constraints as shown on the Garfield County Comprehensive Plan Management Districts Map. NESCRIPTTON OF THE PROPOSAL Site Description: The subject parcel is located on the south side of County Road 115, in the Spring Valley area. The tract has slopes from the north to the south at grades between l0% and 20o/o. The vegetation is sage brush and scrub oak. There is an existing dwelling unit Eurrently located on the exenrption paroel. A vicinity map is shown on pagt I. . Request: The applicant is requesting to split a 10.0 acre parcel into two 5.0 acre parcels. The proposed supply of water is an existing well that would be shared by both lots. Each lot would have individual sewage disposal systems. Access to the lots would be offof C.R. I15. A. B. ? l- III. MAJOR ISSTTES AND CONCFRNS Section 8: 10 (Applicability-Exemptions) states that the Board has discretionary authority to except a division of land from the definition of suMivision. Following a review of the facts of each application, the Board may approve conditionally or deny an exemption request. The Board may not grant an exemption unless the applicant can demonstrate compliance with zoning, legal aooess, adequate water and sewer, state environmental health standards, necessaryroadanddrainageimprovements, fireprotection, adequateeasernents and school impact fees. Exemfrtion Criteria. Section 8:10, states that the Board may approve a total of four (4) lots parcels, interests or dwelling units, as that parcel was described in the records of the Garheld County Clerk and Recorder's offrce on January l, 1973. Enclosed with the application is a copy of a deed showing the tract of land was in existence ,as it is now, on June 24, 1971. Based on this information, the applicant qualifies lor the proposed exemption. Water and Sewer. The applicant has an existing well permit for the exemption parcel. The State Engineer's Office has reviewed the application verbally, and has indicated that the well for the parcel may be shared or possibly a new inhouse use only well could be issued for the proposed new paroel. Any approval should be contingent on the issuance of a new well pennit or a letter from the Division of Water Resources stating that the existing well can be shared. If a shared well is used, the exemption plat will have to have easements around the well and proposed water line for maintenance and repair purposes. Sewage disposal will be handled by ISDS. Predominate soils on the site according to SCS Soils reports the site has severe constraints for ISDS and dwellings with basernents . A plat note stating that engineered foundations and ISDS may be necessary for the site is appropriate. Natural Hazards. The site is not identified as have soil, slope or ISDS constraints by the Lincoln-Devore Hazards Mapping. Therefore, no platnotes or conditions of approval are necessary. The title insurance submitted with the application indicated that is a ditch on the property, however the ditch is not shown on any of the site maps submitted. If the ditch noted is still used , it should be shown on the exemption plat as a legally described easement. TV. SUGGESTED FINDINGS The proposal is in general compliance with the Garflreld County Comprehe,nsive Plan and the Garheld County Zoning Regulations. The proposed land use would be consistent and compatible with the existing surrounding land uses. t The proposal is in best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 1. ) 3. 4. 5. l. 3. e2o v-RECOMMENDATION OVAL, subject to the following conditions: All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (l) year. The applicant shall submit $200 in School Impact Fees, prior to the signing of an exernption plat. A final exemption plat will be submitted, indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, ac@ss to a public right-of-way, and any proposed easements for drainage, irrigation, access and utilities. If a shared well is used , an aoce$t, repair and maintenance easement at least twenty feet (20') square around the well and ten feet (10') wide around the waterline shall be shown on the plat. A driveway permit, if necessary, shall be obtained from the Road and Bridge Department prior to signing of a final plat. Control of noxious weeds is the responsibility of the property owner. USFS Wildfire Protection Guidelines shall be followed for all structures. Easements for the use and maintenance of the existing ditches, if necessary, shall be shown on the final plat.
