Regardless ot any communications, meetings, or negotiations with the Department regarding revisions and objections to
the permit, if the permittee or applicant wishes to appial the-Department's decision to the Commission' the appeal must be
6iousnt to the Commission wiihin 60 days of transmittal ol the permit.
Any appeal by the applicant or permittee of action by the local issuing authority.whgn.i: ls-the appropriate local authority
(under subsection 2.4), shall be filed wiilr tne-iocJ Luthority and beionsistent with the appeal procedures of the local
authority.
lf the final action is not further appealed, the Department or local authority may record the decision with the county clerk
and Becorder.
ll Construction standards and reguirements
1. The access must be under construction within one year of the permit date. However, under certain conditions a one year
time extension may be granted if reguested in writing priqr to permit expiration'
z. Theapplicantshall notifytheofficespecifiedonthepermitatleast4Shourspriortoconstruction'Acopyofthepermitshall
be available for review at the construction-site. lnspections will be made during construction'
3. The access construction within highway right-of-way must be complbted within 45 days'
It is the responsibility of the permittee to complete the construction of the access according to the terms and conditions of
the permit. lf the permittee wishes to use the "c""it prio|. to completion, arrangements must be approved by the issuing
authority and Depanment and included on in. p"rrit. The Department or iisuing authority may order a halt to any
unauthorized use of the access. ReconstructiJn orimprovements to the access may oe required when the permittee has
failed to meet required specifications oi oesiln or materiats. lf any construction element fails within two years due to
improper construction-oi-materiaf specif icatio-ns, the permittee is responsible for all repairs'
ln the event ii becomes necessary to remove any right-of-way fence, the posts on either side of the access shall be securely
braced with an approved end post bef ore the te'ncJls cut to frevent any slacking of the remaining fence' All posts and wire

The access shall be constructed and maintained in a mannerthat shall not cause waterto enter onto the roadway' and shall
not interfere with the drainage system in the right-o{-way'
where necessary to remove, relocate, or repair a traftic control device or public or private utilities for the construction ol a
permitted access, the wor,r shall be accomplished by the permittee without cost tothe Department or issuing authority' and
at the direction of the Depr:,rment or utitity "*prny. Any damage to the state highway or other public right-of-way beyond
that which is allowed in ine permit shall be recaired immediately.
Adequate advance warnrng is required at all times during access construction, in contormance with the Manual on Unilorm
Traflic control Devices i cr streets and Highways. This may include thEuse of signs' f lashers' barricades and flaggers' This

agents and employees shall be held narmtess ajainst any action ior personal inlury or property ciamage sustained by
reason of the exercise of the permit.

redesign the highway including any auxiliary lane'
Any driveway, whether constructed before, on, or alter Jun. 30, 1979, may be required by the Department, with written

All terms and conditions of the Permit are binding upon all assigns, successors-in-interest and heirs'
when a permitted driveway is constructed or used in violation oi the Access code, the local government or Department may
obtain a court order to halt the violation. Srcn-access permits may be revoked by the issuing authority'

1 . When the permit holder wishes to make improvements to an existing legal access' he shall make his request by f iling a

This WATER SERVICE AGREEMENT is made beween the TOWN OF CARBONDALE,
COLORADO ("Town") and IvLIN l"U.{D I}flESTMENTS ("lv1,llf')and shall become effective
May 25, tggg,regardless of the actual date of execltion by the parties.
RECITALS:
A. MJN is rhe owner of ttre properry described on E:rtribitA attached hereto and
incorporated herein by this reference (*re "Property''). The Property is located adjacent and
outside the boundaries of *re Town. I{.lN is currendy seeking approval from Garfield
County of a subdivision exemption for sudr Property. This agreement is related to Lots A
and C of said proposed subdivision exemption.
B. By Resolution No. gi-4,Series of 1995, the Town exended a moratorium
against the issuance of additional out-of-town water taps and enacted a moratorium against
issuance of additional out-of-town sewer taPs.
C. By Resolution No. gg-t!, Series of 7999, the Board of Trustees of the Town
granted an exemption from the moratorium on out-of-town water taps, subject to certain
Ionditions as set iorth therein, allowing MJN to extend a six inch water service line and use
water from the line on said Lots A & C.
AGREEMENT:
In consideration of ttre muilal covenants andpremises contained herein, the parties
agree as follows:
1. Water Service Linq Extension, fr. Town hereby Srants MJN the right to
constnrct an extension of a six inch water iervice line from the existing water main line
IocatedintheStateHighwayl33right-of.way(hereinreferredtoas.\^,aterlineelcension,').
prior to constmction, fr{"lN it aU proride the Town with a cost estimate for construction and
installation of the water line and all components for review and approrral by ttre Town. The
cost estimare shall show the difference in cost between a four (a) inch and six 6) indt line.
If the cost estimate is approved, the Town agrees to reimburse IvLIN following consuuction
for the cost of upsizing the line from four (4) to six (6) inches in diameter. All construction
of the line, metlrs, and meter pits shall be subjea to the provisions of Resolution No. 11,
Series of 1999, and ttre provisi-ons hereof and shall conforrr to Town standards, including
the provisiorrr if Colorado uuiricipal Code 5L3.24.020. The plans and specifications for ttre
watir line extension shall be prep-ared by engineers on behalf of Ir4JN and shall be subject
to prior approval by ttre Town Public Work/Utility Deparunent. MJN agrees to consEruct
ttre watei line extension in accordance with *re approved plans and specifications. No
construction shallbe undertaken until the Town has approved suchplans and qpecifications.
Ttre Town hereby grants MJN the right to enter the public utility easement in the State
Highway 133 right-of-way for purposes of consu:uction of ttre water line extension' MJN
agrees to repair any damage to Properrywithin such public utility easem€nt and restore the

WEEREAS, Declarant is the owtrer of a parcel of land commonly known and
described as the M.J.N. Subdivision Exemption (the "subdivision") containing

WEEREAS, the Subdivision consists of four (4) lots, described as Lots A, B, C
and D; and
WEEREAS, on Lot D of the Subdivision there is an existing domestic water well
(the "Well") serving the existing single-family residence on Lot D; and
WEEREAS, Declarant is desirous of providing that the future single-family
residence constructed on Lot B of the Subdivision snau be entitled to jointly use the well
with the owtrer of Lot D; and
WEEREAS, Declarant desires to establish joint use and maintenance covenants,
conditions and restrictions governing the Well'
BASED ON THE FOREGOING, Declarant hereby establishes the following

Dear Syd:
I met with Mark Nieslanik to rwiew tle conditions of Crarfield County's approval of
the MIN Subdivision exemption. We would like to add the following additional feafires to
the oremption plat map:
l. Show location of access easement through the Kline property, as it extends
from State Highway 133 to reach the subdivision. Enclosed is a copy of the Kline easemetrt.
2. Show building setbacks and easement for access and utilities. In this regard,
Mark Nieslanik informs me that all utility easements will be underground, and located within
the roadway easement. I think it appropriate to change the label ofthe "ac,cess easement" to
"access and underground utilities easement." This should allow for the logical ortension of
utilities to serve the improvements to be constructed on the lots.
3. Show ttre location of the Ella Ditchwhere it passes underneaththe access
road serving the subdMsion. Enclosed is a free-hand sketch of the approximate location of
the ditch.
4. Attached to this letter are plat notes the Garfield County Planning Office
requests be added to the plat.

l. Control of noxious weeds is the responsibility of the property owner.
2. One (l) dog will be allowed for each residential udt within a platted lot,
and the dog shall be required to be confined within the owner's property boundaries.
3. No open hearth sold-fuel fireplaces will be allowed anywhere. One (1) new

This neport gives estimates of vanious soil features. The estimates are used in Iand use planning that involves
engineering considenations'
Depth to bednock is given if bedrock is within a depth of 5 feet. Ihe depth is based on rnanv soil bonings and on
observations durins soil mapping. the nock is eithen'Soft'or 'Hard'. If the nock is'Soft'on fractured, excavations
can be made with trenching machines, backhoes, on small rippers, if the rock is "Hard'on massive, blasting on
special equipment genenallv is needed for excavation'
Cemented pans are cemented on indunated subsunface layers rlithin a depth of 5 feet. Such pans cause difficulty in
excavation. Pans ane classified as'Thin" on "Ihick'. A'Ihin" pan is Iess than 3 inches thick if continuousiv
indunated or Iess than 18 inches thick if discontinuous or fnactured. Excavations can be made bv tnenching rnachines,
backhoes, or smail nippers. A'Ihick'pan is more than 3 inches thick if continuouslv indunated 0r lnone than 18
inches thick if discontinuous or fnactured. Such a pan is so ihick or massive that blasting or speciai equipment is
needed in excavation.
Subsidence is the settlement of organic soils or of satunated mineral soils of venv low density' Subsidence
results from eithen desiccation and shrinkage on oxidation of organic material, ot both, follorling drainage.
Subsidence takes place graduaily, usually oven a period of several yeans. This neport shor.rs the expected initial
subsidence, rlhich usually is a result of drainage, and total subsidence, uhich usuallv is a nesult of oxidation. Not

drained. Siity and highly structured clayey soils that have a high rlaten table in winten ane the most susceptible to

Risk of conrosion pertains to potential soil-induced electrochemical or chemical action that dissolves on ueakens
uncoated steel on conmete. The r ate of connosion of uncoaied steel is nelated to such factors as soil moistune,
particle-size distr ibution, acidity, and electnical conductivity of the soil. Ihe nate of cornosion of conffete
is based mainly on the sulfate and sodium content, texture, moisture content, and acidity of the soiL Special
site examination and design may be needed if the combination of factons *eates a severe corrosion envinonment. Ihe steel

Roadfill is soi] matenial that is excavated in one place and used in noad embankments in anothen place. In this neport,
the soiis are nated as a source of noadfilt fot low embankments, genenaliv less than 6 feet hish and less
exacting in design than highen embankments. The r atings ane fon the soil material belo'l the sunface laver to a
depth of 5 or 6 feet. It is assumed that soil Iayers will be mixed duning excavating and spreading. l'lany soils have
iayers of contnasting suitability uithin their^ pr ofile. The nepont entitled Engineering Index Propenties is aiso available

and slope. Horl uell the soil performs in place after it has been compacted and dnained is determined by its strengih (as
inferred from the engineening classification of the soil) and shnink-srleI] potential.
Soils rated'Good'contain significant amounts of sand on gnavel on both. They have at least 5 feei of suitable
material, a lou shnink-suell potential, feu cobbles and stones, and slopes of 15 pencent on Iess. Depth to the
water table is more than J feet
Soils r^ated'Fair'have mone than 35 percent silt- and clay-sized panticles and have a plasticity of less than 10.
Ihey have a moderate shnink-suell potential, slopes of 15 to 25 pencent, 0n tnanv stones' Depth to the uater table is 1
to 3 feet.
Soils rated'poor" have a plasticity index of mone than 10, a high shnink-srrell potential, many stones, or slopes of
mone than 25 percent. They ane wet, and the depth to the water table is Iess than 1 foot. These soils mav have
Iayens of suitable material, but the material is Iess than 3 feet thick.
Sand and gravel ane natural aggregates suitable fon commercial use rlith a minimum of pt"ocessing. Sand and
gravel are used in many kinds of construction. Specifications for each use vany widely' In this nepont only
the pnobability of finding materiai in suitable quantity is evaluated. The suitabilitv of the material fon specific
purposes is not evaluated, non are factons that affect excavation of the matenial. The pnopenties used to evaluate
the soii as a source of sand on gnavel are gradation of gnain sizes (as indicated by the engineering classification
of the soil), the thickness of suitab),e material, and the content of nock fnagments. Kinds of rock, aciditv, and

uildlife habitat; and in detenmining the intensity of management needed for each element of the habitat. The
potential of the soil is rated'0ood,''Fain,"Poor,'or'Veny poon.' A nating of "Good'indicates that the element
on kind of habitat is easily established, impnoved, on maintained. Ferl or no Iimitations affect management, and
satisfactonv nesults can be expected. A rating of "Fair" indicates that the element or kind of habitat can be

millimeter in diameter. In this nepont, the estimated clav content of each major soil Iaven

CATIoN EXCHANGE CAPACITY (CEC) is the total amount of calions held in a soil in such
a rlay that they can be nemoved only by erchanging with another cation in the natunal
soiution. CEC is a measune of the ability of a soil to retain cations, some of r'lhich
plant nutnients, SoiIs uith lou CEC hold few cations and may nequine more frequent
applications of fentilizens than soils uith high CEC. Soils uith hish CEC have the

in determinins the nisk of conrosion.
CALCIUlI CARBoNATE is the pencentage by ueight of calcium canbonate in the fine-earth

Gypsul'l is the pencentage by weight of hydrated caicium sulfates 20 millimetens or
smallen in size, in the soiI.
SALINITY is a measure of soluble salts in the soil at satunation. It is expressed
as the electnical conductivity of the satunation extnact, in millimhos pen centimeten

The salinity of irnigated soils is affected by the quality of the inrigation water

pore space, and other soil properties. The moist bulk density of a soil indicates the pone space available fon
uaten and roots. A bulk densiiy 0f more ihan 1.6 can nestrict waten storage and root penetnation' tloist

MJN INVESTMENTS SUBDTVISION EXEMPTION APPLICATION
Enclosed is the last staffreport presented to the Board on617l99 and continued a number of
times since that date. The meeting was opened and continued, subject to the applicants resolving
various issues. Since that time the applicants have met all ofthe proposed conditions, except for
condition no. 8. The Reeds withdrew their consent to allow for the emergency access, based
upon the enclosed statements. Subsequently, the applicants have worked with the Carbondale
and Rural Fire Protection District to develop a fire protection program that includes a fire
hydrant. The previous recommendation of approval was based upon a different form of
emergency protection based upon the easement across an adjoining piece of property. The
Carbondale and Rural Fire Protection District has no problems with the fire protection issues,
based upon the installation of the fire hydrant.

Dear Mark:
I have met MarkNieslanik and reviewed the final plat drawings for the proposed M.J'N
subdivision. The fire district had commented previously in 1997 teguding the access to the
property. Mark and I discussed the emergency access easement that had been sought to the
,orif, oitot ..D,, and that they were unable to obtain an easement from the adjoining property
owner. The access to the development is acceptable without the emergency easement
considering the proposed number and density of the lots'
The developers have received approval from the Town of Carbondale to connect to the town's
water system. They propose extending a six-inch water main to Lot ooA" and installing a fire
hydrani along tt " *ua near the hairpin curve. The proposed location for the hydrant is
acceptable.
The new lots created in the development are subject to impact fees adopted by the District' The
developer will be r"q"ir"a to enteiinto an agreement with the District for the payment of
development impact fees. This payment is due prior to the recording of the final plat' Fees are
based upon the per lot impact fee adopted by the District at the time the agreement is executed'
The current impact fee is $417 per lot'
