COUNTY OF GARFIELD ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Courthouse in Glenwood Springs on Monday the 2Ot1,day of October, A.D., 1997, there were present: Larry McCown Marian I. Smith John Martin Don K. DeFord Mildred Alsdorf , Commissioner , Commissioner Chairperson , Commissioner , County Attorney , Clerk to the Board when the following proceedings, among wit: others were had and done, to - RESOLUTION NO. 97- 96 RESOLUTION ACCEPTING TEMPORARY EASEMENT AND TRAFFIC CONTROL SIGNAGE FOR ROAD 335 WHEREAS, the Board of County Commissioners of Garfield County, Colorado have previously approved a final plat for the Rapids Subdivision fronting upon an access on County Road 335; an WHEREAS, the owner of the foregoing noted subdivision has undertaken necessary improvements and modifications to County Road 335 as it adjoins the access to said subdivision; and WHEREAS, the construction of those modifications necessitate the temporary detour of traffic from County Road 335 through the subdivision to allow the foregoing noted construction. NOW, THEREFORE, BE IT RESOLVED By the Board of County Commissioners of Garfield County, as follows: 1. The Board of County Commissioners of Garfield County, Colorado, herein accepts, and the Chair is authorized to sign an agreement accepting a temporary easement for construction to be located within the confines of the Rapids Subdivision. 2. The foregoing noted easement will be accepted as a public road on a temporary basis during the course of construction on County Road 335, which construction is not anticipated to exceed four weeks in length. 111111111111111111111111111111III 111111 111 11111 1111 1111 515375 10/22/1997 01:53P B1039 P529 447 2 of 2 R 0.00 D 0.00 N 0.00 GARFIELD CLERK 3. During the duration of the use of the temporary easement noted herein, the temporary easement shall be posted with a speed limit of 20 miles per hour, and shall be enforced by all appropriate law enforcement officials. Said speed limit is necessitated based upon the testimony of the engineer designing the temporary easement as an appropriate and safe speed for utilization during the time period for the existence of that temporary easement.
