PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the
Subdivision Regulations of Garflreld County, Colorado, adopted April23, 1984 Section 2:20.49,
the undersigned VIOLET GOODSELL respectfully petitions
the Board olCounty Commissioners oIGarfield County, Colorado, to exempt by Resolution
the division ol 52 acre tract of land into 3 tracts of approximately -
20, 20 and, L2 acres each, more or less, from the dehnitions of "subdivision" and
"subdivided land" asthetermsareused and dehned in C.R.S. (1973) Section 30-28-101 (10) (a)
- (d) and the Garheld County Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUTREMENTS:
An application which satisFres the review criteria must be submitted with all the following
information:
A. Sketch map at a minimum scale of l "=200' showing the legal description of the
property, dimension and area of all lots or separate interests to be created, access
to a public right-of-way, and any proposed easements lor drainage, irrigation,
access or utilities;
B. Vicinity map at a minimum scale of l"=2000' showing l,he general topographic
and geographic relation of the proposed exemption to the surrounding area
within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter from the
property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately adjoining and
within 200 feet of the proposed exemption, mineral owners and lessees ofmineral
owners of record of the property to be exempted, and tenants of any structure
proposed for conversion; and
E. Evidence of the soil types and characteristics oleach type; and
F. Proof of legal and adequate source of domestic water lor each lot created,
method of sewage disposal, and letter olapproval of hre protection plan from
appropriate fire district; and
G. If connection to a community of municipal water or sewer system is proposed,
a letter from the governing body stating a willingness to serve; and
H. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on January 1,1973
or the parcel as it exists presently is one of not more than three parcels created
from a larger parcel as it existed on January 1,1973.

EXEMPTION
APPLICABILITY
The Board of County Commissioners has the discretionary power to exempt a division of land
from the definition of subdivision and thereby from the procedure in these Regulations,
provided the Board determines that such exemption will not impair or defeat the stated purpose
of the Subdivision Regulations nor be detrimental to the general public welfare. The Board
shall make exemption decisions in accordance with the requirements of these regulations.
Following a review of the individual facts of each application in light of the requirements of
these Regulations, the Boardmay approve, conditionally approve or deny an exemption. fui
application for exemption must satisfy, at a minirnum, all of the review criteria listed below.
Compliance with the review criteria, however, does not ensure exemption. The Board also may
consider additional factors listed in Section 8:60 of the Subdivision Regulations.
A.No more than a total of four (4) lots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the Garflreld County
Clerk and Recorder's Offrce on January 1, 1973, and is not a part of a recorded
subdivision; however, any parcel to be divided by exemption that is split by a public
right-of-way (State or Federal highway, County road or railroad) or natural feature,
preventing joint use of the proposed tracts, and the division occurs along the public
right-of-way or uatural feature, such parcels thereby created may, at the discretion of
the Board, not beconsidered to have been created by exemption with regard to the four
(4) lot, paroel, interest or dwelling unit limitation otherwise applicable;
All Garfield County zouing requirements will be met; and
All lots created will have legal access to a public right-of-way and any necessary access
easements have been obtained or are in the process of being obtained; and
Provision has been made for an adequate source of water in terms of both the legal and
physical quality, quantity and dependability, and a suitable type of sewage disposal to
serve each proposed lot; and
All state and local environmeutal health and safety requirements have been met or are
in the process of being met; and
Provision has been made for any required road or storm drainage improvements; and
Fire protection has been approved by the appropriate fire district; and
Auy necessary drainage, irrigation or utility easements have been obtained or are in the
process of being obtained; and
school fees, taxes and special assessments have been paid.
(The school Impact Fee is $200.00 for each new lot created).

PROCEDURES
A' A request for exemption shall be submitted to the Board on forms provided by the
Garfield County Department ofDevelopment/Planning Division. Two (2) copies ofthe
application maps and supplemental information shall be submitted.

ThePlanning Divisionshall reviewtheexemption requestforcompleteness within eight
(8) days of submittal. If incomplete, the application shall be withdrawn from
consideration and the applicant notified of the additional information needed. If the
application is complete, the applicant shall be notified in writing of the time and place
of the Board of County Commissioners meeting at which the request shall be
considered. Ineithercase, notification shall occurwithin fifteen (15) days ofsubmittal.
Notice of the public meeting shall be mailed by certif-red mail, return receipt requested,
to owners of record of land immediately adjoining and within 200 feet of the proposed
exemption, to mineral owners and lessees of mineral owners of record of the land
proposed for exemption, and to tenants of any structure proposed for conversion. the
exemption site shall be posted clearly and conspicuously visible from a public right-of-
way with notice signs provided by the Planning Division. All notices shall be mailed at
least fifteen (15) and not more than thirty (30) days prior to the meeting. The applicant
shall be responsible for mailing the notices and shall present proof of mailing at the
meeting.
At or within fifteen (15) days of the meeting, the Board shall approve, conditionally
approve or deny the exemption request. The reasons for denial or any conditions of
approval shall be set forth in the minutes of the meeting or in a written resolution. An
applicant denied exemption shall follow the subdivision procedure in these regulations.
NARRATIVE EXPLANATION
MOONEY SUBDIVISION EXEMPTION
The following is a narrative explanation of the Petition for
Subdivision Exemption of Violet Mooney, formerly known as Violet
Goodsell:
ltrs. Mooney owns a 52 acre parcel on a bluff overlooking theentrance to Canyon Creek near its confluence with the ColoradoRiver. Mrs. Mooney and her late husband, Earl Goodsell, purchased
the property in L949 and lvlrs. Mooney has maintained a residence onthe property for most of the past 46 years. Mrs. Mooney desires todivide the tract into two 20 acre parcels to be used as residencesites for her two grandchildren, Joshua Goodsell and Monica Vigil,
and to retain the remaining L2 acres for herself. Since she andEarl Goodsell purchased the property, it has never been divided,
although a boundary adjustment of 0.15 acres was made to the Estate
of Henry P. Wil1iams, Jr. in L992 which removed such acreage fromMrs. Mooneyrs property and attached it to Lot 2 of the Senor Mesa
Exemption.
The remainder of the narrative will be addressed to theSubmittal Requirements, A through Jt pertinent Review Criteria on
Page 2 of the Petition for Exemption and matters that need comment
because of Section 8.60 of the Garfield County Subdivision
Regulations.

Exhibit rrErr explains that prior to f iling the exemption theAssistant Planner explained that information concerning soils neednot be obtained from the SCS because such information was already
on file in the Planning Office.
Exhibits "F-1" and "F-2" provide evidence that a Well Permit
has been applied for and the opinion of Resource Engineering, Inc.that such Well Permit will be granted. Because there is alreadyanother existing well on the property, not far from the proposed
new we11, it is extremely likely that potable water will be
located.
Exhibit.F-3" is a copy of the Share Certificate in theWilliams Cana1 Company which will provide irrigation water to thethree tracts. The division of the water among the three tracts isset forth in Exhibit 'G'.
Exhibit "F-4" is the adjudication for the existing well on the
Mooney tract.
Exhibit rrHrr meets the requirements concerning fire protection.
As previously explained, Exhibit trlrr is evidence of the L992
boundary adjustment as to 0.L6 acres.
Exhibit rrcrr is the proposed Covenants that will attach to thenewly proposed Tracts governing easements for irrigation water,drainage, utilities, and well water between the parcelsr €rs well as
road access and other important matters to be regulated between thetract owners.
A11 requested fees are included or wiIl be paid at theappropriate time.
COMMENTS REGARDING SUBDIVISION REGULATIONS sEcrroN 8. 50.
Petitioner has reviewed theSection 8.60 of the Garfield Countythe following comments:

As to Additional Considerations A. and B., Petitioner believes
that the proposed property Exemption conforms with the Countyr s
comprehensive plan and is compatable with surrounding land uses
which have become increasingly rural residential in nature.
As to Additional Consideration C., there is no municipality
within three miles of the subject property.
As to Additional Considerations D., E. and F. of Section 8.60,
these are subjective criteria, the interpretation of which is left
to the County Planning Staff and the Commissioners. SoiIs
information is available within the Planning Department. (See
Exhibit "E')
As to Additional Consideration G., the exemption proposes to
Iocate two additional residences on the 20 acre Tracts which should
Ieave adequate open space.
As to Additional Consideration H., the residential density of
these Tracts will be less than that of many surrounding or adjacent
parcels, and obviously off street parking will be available.

RE: Mooney Exemption
Dear Commissioners:
December 7, 1995
We have evaluated the potential for obtaining a physical and legal water supply for two
single famity homes on a parcel of property in Garfield County owned by Violet
Mooney. We understand that the property is the subject of a subdivision exemption
request.
Based upon our research of the localgeology, well records for this area and discussions
with locat wel! dritler, Cotlins Drilting, we have concluded that the possibility of
obtaining an adequate physical water supply in the Maroon formation at a depth of
150' to 20O' is very good.
We have atso concluded that the property will qualify for an exempt domestic well
permit. Ms. Mooney owns sufficient property to dedicate 35 + acres to this proposed
wel!. tt will be the only well on 35 acres and will serve only two single family homes.
A copy of the welt permit apptication which has been submitted to the State Engineer's
office is attached.
ln summary, it is our opinion that both a physical and legal water supply are obtainable
for this proposed subdivision exemption.

This is a52 asetrast ofland locatd northwest ofthe confluence of Canyon Creek and the Colorado
River, north of I-70. The southeastern portion of the property slopes gertly becoming more stee,p
to the northwest. A number of existing structures exist on the tract, 2 of which appear to be single
frmily dwellings and another single family dwelling is currently under construction. There are also

In response to your request for comments regarding the proposed Mooney
Subdiwision Exemption located % mil"e north of I-70 off County Road 137, I
offer the following statements for your February 5, 1995 public meeting. The
northern edge of the 52 acre tract is adjacent to public lands administered by
this office. Current uses on the BLM include wildlife habitat, livesEock
grazLng, and dispersed recreation such as hunting.

permits for livestock grazing. Under Colorado statutes, it is a landowner's
responsibiliUy to construct, and maintain in good condition, a lawful fence
protecting their property in order to recover any damages from trespass
livestock. If a 1j-vestock fence is not presently in p1ace, a fence builts
along the private/BlM boundary is recommended to resolve this use conflict.
The proponent should be aware of the location of property boundaries to ensure
no encroachment occurs on public 1and. Should any fence construction be
considered along the private/BLM boundary, the fence standards should allow
for easy passage by big game. This office can provide additional information
regarding fence standards upon request.
3. Adjacent public lands are open to hunting and other dispersed recreation
activities. The proponents should be aware that hunting and other recreation
uses are allowed on Bl,M-administered lano.
4. Any roads, traiLs, paths, or utilities (waEer, electric, phone or
otherwise) crossing BI,IvI would require right-of-way (ROW) permits from this
office. An environmental assessment report would be completed as a part of
the ROW permitting process.
5. The proposed subdivision exemption lies within deer critical winter range.
Encroachment of homesites and people on big game winter ranges can have a
deleterious effect on game herd populations and health.

I hesitated to write this letter at all because you havepreviously been wonderfully generous in granting Mrs. Mooney a oneyear extention to complete tlre conditioni related to the ex-emptionpreviously granted her. However, the one year extension will be upon May 4, L997 and proof of fulfillment of the conditions probablyneeds to be submitted to you by Friday, May 2, L997. At the timeof writing this letter, those deadlines are one week away.
While discussing certain aspects of this exemption with theAssistant county Planner, Eric Mccafferty, he suggested that rmight want to request an additional thirty (30) day extention. Myclient and her two grandchildren, who aie helping her with theexemptj-on process, are moving things along as quickly as they can.However, there are certain consultants that have been hired who areextremely busy and, while we are pressing them for performance, ram in fear that certain necessary si-rbmittals might not be obtainedin time to meet the deadline.
I don't want you to think my client has waited until the lastminute to act. Immediately after the one year extention wasgrantedr w€ began working to determine who owned the propertycontrolling my client's access. It then took us about 8 months otpersistent badgering to get a deeded access easement from the HankWilliams Estate. Then we had to wait for the weather to drill thewell in March, 1997.

Mrs. Mooney has owned this real estate for 47 years, havingpurchased the property with her late husband, Earl Goodsell, inL949. However, it wasexplained to you at the hearing that an additional and new roadwould. be built to serve the property coming from the south off ofthe Slaughter House Road, very close to the Canyon Creek exit ofInterstate Highway I-70.

Just prior to the hearingr we had checked out thisparcel between the east boundary and the road and found theAssessorrs Office showed "no ownership" for this parcel and was nottaxing it. to anybody. Consequently, there was no one from whom toobtain an easement or a license. Of course, it is elementary lawthat my client has established a prescriptive right by use of thisroad over 47 years. However, since the gap onry came to ourattention just before the hearing, there had been no chance to goto court and prove up the right to use the driveway through a courtproceeding

the parcel owners, and are set forth as follows:
A. MAINTENANCE AND OWNERSHIP OT IRRIGATION WATER AND DITCII

Declarant states that the owner of Parcel A shaIl bethe owner of 0,6 shares of the Williams Canal Company,and that the owner of Parcel B shall be the owner of 0.6
shares of the Williams Canal Company, and that the ownerof Parcel C sha1l be the owner of 0.6 shares of theWilliams Canal Company, Conveyances of said shares shallbe included within the deeds to each parcel. Inaddition, Declarant's water certificate in the WilliamsCanal Company shall be transferred into three ( 3 )certificates representing the water shares hereinabove
described.
After transfer of said shares as hereinabove described,
each of the owners of the shares shal1 be entitled to the
amount of water to which a share, or fr:action thereof, isentitled in accordance with the rules and regulations ofthe Williams Canal Company.
Each of the owners of the shares formerly owned by theDeclarant, as divided and described above, shall also beobligated for the repair and maintenance costs of theditch applicable to each orrner's proportionate share ofownership in the ditch company in accordance with therules and regulations of the Williams Canal Company.

SHARING OF JOINT WELL BETWEE-N PARCEL A AND PARCEL B:
Parcel A shall contain and include a well which shal1be equally owned and jointly used by the owner oroccupant of Parcel B. At the time Parce1 S is conveyed,there also sha1l be conveyed an easement for a water lj-nefrom the well head to the boundary of Parcel B whichshall be a burden upon Parcel A. The conveyance shallalso include a one-half interest in the well and waterrights.
Parcel C may share in the benefits and burdens of thewell if the owners of Parcels A and B agree, and if allcosts to tap on are paid by Parcel C, and all prior coststo develop the well are shared by Parcel C.

MUTUAL EASEMENTS:
The Declarant and subsequent owner of a parcel, upon
acquiring title thereto, shall be deemed to have
consented to the encumbrance of such owner's parcel with
easements for the benefit of the other parcel owners.
Such easements shaIl be for roadways for vehicular
ingress and egress to each parcel, for utilities of all
kinds, for ditch laterals carrying irrigation water to
each parcel, and for natural runoff of waters according
to historical patterns.
In locating such easements, the owners shall agree on
locations that: (1) do not interfere with residential
building sites on each parcel, and l2l attempt to place
such easements in historically used sites, locations or
corridors (e.g, roads and ditch laterals), and (3) take
into consideration the expense of locating the facilities
in the easement, considerinq the terrain, and (4)
establish utility easements that are near or along
driveways or roadways, where possible, and (5) establish
new utility easements, where possible, on existing
utility poles or in existing underground utility
trenches.
Upon construction of a roadway, ditch lateral, or
facilities for a particular utility, the owner of the
parcel burdened by the easement, within a reasonable
time, shall sign an easement deed to be surveyed,
prepared and presented by the owner or user of the
easement right. Such deed description sha1l be
accompanied by a survey plat shovring a centerline
description of the line of the facilities rvithin the
easement, which shaIl be included in the deed. The width
of the easement shall be described in the deed and shall
be sufficient to reasonably al1ow for repair and
maintenance of the facilities within the easement. The
owner or user of the easement shall be responsible for
maintenance and protection of the facilities within the
easement, including the right and obligation to remove
debris, trees and brush as necessary to protect or
maintain the facilities. Jointly used easements shaIl be
equally maintained by both or all users, either equally,
if appropriate, or on a fairer basis if circumstances
require. In the event of litigation to enforce these
provisions, or collect easement expenses, the prevailing
party shal1 be entitled to attorney fees and costs.
BOUNDARY FENCES:
The owner of each parcel shal1 have the right to
construct fences along the boundary of the parcel so long
as the rights of the adjacent parcel olvners are not
interfered with and the rights of easement owners or
users are not interfered with. Locked gates shall only
be allowed with the hrritten consent of other affected
parcel owners.
RIGHT OF TIRST REFUSAL:
There is hereby imposed upon the initial ohrners of the
parcels above described, and such is also granted for the
benefit of said initial owners, the right of first
refusal to purchase any of the three parcels from any of
the initial owners should any of said owners desire to
sell the same. However, this right of first refusal
shall only be binding upon the initial owners and shall
not apply to any other or subsequent owners of saidparcels. The term "initial ownersrr sha1l include the
Declarant.

If at any time any one of the initi.al owners of theparcels hereinabove described should receive a bona fide,written offer to purchase his or her parcel signed by aprospective purchaser thereof, such initial owner who hasreceived such offer sha11 proceed as follovrs:
1. vlithin five (5) days after receipt of the writtenoffer, a true and correct copy thereof shall befurnished to any other initial owner who is sti1lthe owner of his or her parcel. Such offer may bedelivered in person or may be sent to the otherinitial owner or owners by certified mai1, returnreceipt requested. the date of mailing to be withinsaid five (5) day period.
2. After receipt of the offer by the other initial
ohrners (those who are not selling their parcels),
such other owners shal1 have ten (10) days within
which to meet or beat the written offer presented tothem. In order to meet or beat the terms of thepresented offer, the other owners must agree inwriting to the identical price, terms andconditions, or to a price which is in excess of theprice of the offer, but upon the same terms andconditions,
3. If one of the other o\^,ners shal1 meet or beat thepresented written offer, then the other owner whohas met or exceeded the written offer shatt besubstituted for the original purchaser and the saleshall be closed in accordance with the writtencontract.
