(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garflreld County, Colorado, adopted April23, 1984 Section 2:20.49, the undersigned VIOLET GOODSELL respectfully petitions the Board olCounty Commissioners oIGarfield County, Colorado, to exempt by Resolution the division ol 52 acre tract of land into 3 tracts of approximately - 20, 20 and, L2 acres each, more or less, from the dehnitions of "subdivision" and "subdivided land" asthetermsareused and dehned in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) and the Garheld County Subdivision Regulations for the reasons stated below: See Narrative Attached SUBMITTAL REQUTREMENTS: An application which satisFres the review criteria must be submitted with all the following information: A. Sketch map at a minimum scale of l "=200' showing the legal description of the property, dimension and area of all lots or separate interests to be created, access to a public right-of-way, and any proposed easements lor drainage, irrigation, access or utilities; B. Vicinity map at a minimum scale of l"=2000' showing l,he general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used. C. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and D. Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees ofmineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion; and E. Evidence of the soil types and characteristics oleach type; and F. Proof of legal and adequate source of domestic water lor each lot created, method of sewage disposal, and letter olapproval of hre protection plan from appropriate fire district; and G. If connection to a community of municipal water or sewer system is proposed, a letter from the governing body stating a willingness to serve; and H. Narrative explaining why exemption is being requested; and I. It shall be demonstrated that the parcel existed as described on January 1,1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcel as it existed on January 1,1973. Petitioner 0L52 Road L37 Mailing Address Glenwood Springs CO 81601 City State (97 0l 984-2952 Telephone Number EXEMPTION APPLICABILITY The Board of County Commissioners has the discretionary power to exempt a division of land from the definition of subdivision and thereby from the procedure in these Regulations, provided the Board determines that such exemption will not impair or defeat the stated purpose of the Subdivision Regulations nor be detrimental to the general public welfare. The Board shall make exemption decisions in accordance with the requirements of these regulations. Following a review of the individual facts of each application in light of the requirements of these Regulations, the Boardmay approve, conditionally approve or deny an exemption. fui application for exemption must satisfy, at a minirnum, all of the review criteria listed below. Compliance with the review criteria, however, does not ensure exemption. The Board also may consider additional factors listed in Section 8:60 of the Subdivision Regulations. A.No more than a total of four (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garflreld County Clerk and Recorder's Offrce on January 1, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County road or railroad) or natural feature, preventing joint use of the proposed tracts, and the division occurs along the public right-of-way or uatural feature, such parcels thereby created may, at the discretion of the Board, not beconsidered to have been created by exemption with regard to the four (4) lot, paroel, interest or dwelling unit limitation otherwise applicable; All Garfield County zouing requirements will be met; and All lots created will have legal access to a public right-of-way and any necessary access easements have been obtained or are in the process of being obtained; and Provision has been made for an adequate source of water in terms of both the legal and physical quality, quantity and dependability, and a suitable type of sewage disposal to serve each proposed lot; and All state and local environmeutal health and safety requirements have been met or are in the process of being met; and Provision has been made for any required road or storm drainage improvements; and Fire protection has been approved by the appropriate fire district; and Auy necessary drainage, irrigation or utility easements have been obtained or are in the process of being obtained; and school fees, taxes and special assessments have been paid. (The school Impact Fee is $200.00 for each new lot created). B. C. D. G. E. F. H. I. PROCEDURES A' A request for exemption shall be submitted to the Board on forms provided by the Garfield County Department ofDevelopment/Planning Division. Two (2) copies ofthe application maps and supplemental information shall be submitted. C. D. ThePlanning Divisionshall reviewtheexemption requestforcompleteness within eight (8) days of submittal. If incomplete, the application shall be withdrawn from consideration and the applicant notified of the additional information needed. If the application is complete, the applicant shall be notified in writing of the time and place of the Board of County Commissioners meeting at which the request shall be considered. Ineithercase, notification shall occurwithin fifteen (15) days ofsubmittal. Notice of the public meeting shall be mailed by certif-red mail, return receipt requested, to owners of record of land immediately adjoining and within 200 feet of the proposed exemption, to mineral owners and lessees of mineral owners of record of the land proposed for exemption, and to tenants of any structure proposed for conversion. the exemption site shall be posted clearly and conspicuously visible from a public right-of- way with notice signs provided by the Planning Division. All notices shall be mailed at least fifteen (15) and not more than thirty (30) days prior to the meeting. The applicant shall be responsible for mailing the notices and shall present proof of mailing at the meeting. At or within fifteen (15) days of the meeting, the Board shall approve, conditionally approve or deny the exemption request. The reasons for denial or any conditions of approval shall be set forth in the minutes of the meeting or in a written resolution. An applicant denied exemption shall follow the subdivision procedure in these regulations. NARRATIVE EXPLANATION MOONEY SUBDIVISION EXEMPTION The following is a narrative explanation of the Petition for Subdivision Exemption of Violet Mooney, formerly known as Violet Goodsell: ltrs. Mooney owns a 52 acre parcel on a bluff overlooking theentrance to Canyon Creek near its confluence with the ColoradoRiver. Mrs. Mooney and her late husband, Earl Goodsell, purchased the property in L949 and lvlrs. Mooney has maintained a residence onthe property for most of the past 46 years. Mrs. Mooney desires todivide the tract into two 20 acre parcels to be used as residencesites for her two grandchildren, Joshua Goodsell and Monica Vigil, and to retain the remaining L2 acres for herself. Since she andEarl Goodsell purchased the property, it has never been divided, although a boundary adjustment of 0.15 acres was made to the Estate of Henry P. Wil1iams, Jr. in L992 which removed such acreage fromMrs. Mooneyrs property and attached it to Lot 2 of the Senor Mesa Exemption. The remainder of the narrative will be addressed to theSubmittal Requirements, A through Jt pertinent Review Criteria on Page 2 of the Petition for Exemption and matters that need comment because of Section 8.60 of the Garfield County Subdivision Regulations. Exhibits rrArr through rrDr should be self-explanatory. Exhibit rrErr explains that prior to f iling the exemption theAssistant Planner explained that information concerning soils neednot be obtained from the SCS because such information was already on file in the Planning Office. Exhibits "F-1" and "F-2" provide evidence that a Well Permit has been applied for and the opinion of Resource Engineering, Inc.that such Well Permit will be granted. Because there is alreadyanother existing well on the property, not far from the proposed new we11, it is extremely likely that potable water will be located. Exhibit.F-3" is a copy of the Share Certificate in theWilliams Cana1 Company which will provide irrigation water to thethree tracts. The division of the water among the three tracts isset forth in Exhibit 'G'. Exhibit "F-4" is the adjudication for the existing well on the Mooney tract. Exhibit rrHrr meets the requirements concerning fire protection. As previously explained, Exhibit trlrr is evidence of the L992 boundary adjustment as to 0.L6 acres. Exhibit rrcrr is the proposed Covenants that will attach to thenewly proposed Tracts governing easements for irrigation water,drainage, utilities, and well water between the parcelsr €rs well as road access and other important matters to be regulated between thetract owners. A11 requested fees are included or wiIl be paid at theappropriate time. COMMENTS REGARDING SUBDIVISION REGULATIONS sEcrroN 8. 50. Petitioner has reviewed theSection 8.60 of the Garfield Countythe following comments: Considerations" in Regulations and has "AdditionalSubdivision As to Additional Considerations A. and B., Petitioner believes that the proposed property Exemption conforms with the Countyr s comprehensive plan and is compatable with surrounding land uses which have become increasingly rural residential in nature. As to Additional Consideration C., there is no municipality within three miles of the subject property. As to Additional Considerations D., E. and F. of Section 8.60, these are subjective criteria, the interpretation of which is left to the County Planning Staff and the Commissioners. SoiIs information is available within the Planning Department. (See Exhibit "E') As to Additional Consideration G., the exemption proposes to Iocate two additional residences on the 20 acre Tracts which should Ieave adequate open space. As to Additional Consideration H., the residential density of these Tracts will be less than that of many surrounding or adjacent parcels, and obviously off street parking will be available. We understand that the property is the subject of a subdivision exemption request. Based upon our research of the localgeology, well records for this area and discussions with locat wel! dritler, Cotlins Drilting, we have concluded that the possibility of obtaining an adequate physical water supply in the Maroon formation at a depth of 150' to 20O' is very good. We have atso concluded that the property will qualify for an exempt domestic well permit. Ms. Mooney owns sufficient property to dedicate 35 + acres to this proposed wel!. tt will be the only well on 35 acres and will serve only two single family homes. A copy of the welt permit apptication which has been submitted to the State Engineer's office is attached. ln summary, it is our opinion that both a physical and legal water supply are obtainable for this proposed subdivision exemption. lf you have any questions, please do not hesitate to call. MUTUAL EASEMENTS: The Declarant and subsequent owner of a parcel, upon acquiring title thereto, shall be deemed to have consented to the encumbrance of such owner's parcel with easements for the benefit of the other parcel owners. Such easements shaIl be for roadways for vehicular ingress and egress to each parcel, for utilities of all kinds, for ditch laterals carrying irrigation water to each parcel, and for natural runoff of waters according to historical patterns. In locating such easements, the owners shall agree on locations that: (1) do not interfere with residential building sites on each parcel, and l2l attempt to place such easements in historically used sites, locations or corridors (e.g, roads and ditch laterals), and (3) take into consideration the expense of locating the facilities in the easement, considerinq the terrain, and (4) establish utility easements that are near or along driveways or roadways, where possible, and (5) establish new utility easements, where possible, on existing utility poles or in existing underground utility trenches. Upon construction of a roadway, ditch lateral, or facilities for a particular utility, the owner of the parcel burdened by the easement, within a reasonable time, shall sign an easement deed to be surveyed, prepared and presented by the owner or user of the easement right. Such deed description sha1l be accompanied by a survey plat shovring a centerline description of the line of the facilities rvithin the easement, which shaIl be included in the deed. The width of the easement shall be described in the deed and shall be sufficient to reasonably al1ow for repair and maintenance of the facilities within the easement. The owner or user of the easement shall be responsible for maintenance and protection of the facilities within the easement, including the right and obligation to remove debris, trees and brush as necessary to protect or maintain the facilities.
