RETATIONSHIP For a S.B. 35 exemption. llartha Murray Sect,lon 20 T 6 S - R93W; located approximately three (3) miles southwest of Rifle off Colorado Road 320. The site is approximately 10 acresin size and is proposed to bedivided into two parcels of 7 acres and 3 acres. Existing and proposed use of water supplied by the City of Rifle. II. DESCRIPTION OF THE PROPOSAL A. Sit,e Description: ffi the edge of Taughenbaugh l1esa, west of Rifle. The proposed 7 acre site contains a mobile home. The proposed 3acre site is a vacant, narrow, triangular shaped lot sparselycovered with native vegatation and steeply cut on thesoutheastern side by the road cut for Colorado Road 320. B. Project Description: The applicants propose to divide a approximately 3 acres and 7 acres. I0 acre lot into two lots of Rifle City water to serve the 3 acre The proposal is to obtainlot. The 7 acre lotcurrently has a septic system and one is proposed for the 3 acreIot. History: The 10 acre parcel wap created in September of 1980 by anexemption for David(F t'targueritt,e Kerh (Resolution *80-215). Theresolution of approval stated that no further exemptions shalltake place on the parcel. However, in May of 1984 the luturrays requested that they be allowed to apply for an exemption based onthe fact that count,y Road 320 divides their property. The Boarddetermined, at that time, that the Murrays could apply for anexemption based on the physical separation of the parcels by a r ight-of-way. -6- III.MAJOR ISSUES AND CONCERNS A. Review Aqencv Comments: I. City of Rifle - The City of cannot serve the proposed 3 B. Staff Comments: Rif1e has indicated that theY acre parcel with water. This will create a long driveway to the potential building site at the south end of the parcel. 3. The shape, required setbacksr €ds€[t€nts, and amount of usable ground on the proposed 3 acre lot will severely linit any building site on the Iot. An individual sewage disposal system on t,he proposed 3 acre lot may be required to be an engineered system, according to the Count,y Environmental Health Officer. 5. The amount of room required for a septic system and the building setbacks from the county road make it questionable whether t,here is a suitable building site on the property without obtaining a varience from the Garfield County Zoning Resolution requlrements for building setbacks. The proposed lot has steep slopes on the southeastern sideof the lot. These slopes are greater than 40 percent. The following is taken from the 5.04.02 Garfield County Zoning Regulations 3 4. 5. Development Limitations Based on Lot Slope:original and undisturbed slope is or was in 40t shall not be credited toward lot area in determining whether a lot meets the minimum requirements set, forth in the zone district regulations, except that up to one-half of the requirernent for open space may be comprisbd of lands in excess of 40t in slope, and no structures or useinvolving t,he disturbance of the land shall be allowed unless lateral support is provided to any affected adjacent landowners, as demonstrated by the materials required by thls section. (A. 80-180) In addition to all other requirements of this Resolution and all other County regulatiollsr thefollowing special requirements shall apply to development where slopes are greater than 40t, and the required materlals Iisted hereunder shall be submittedwith the permit application: 1) A soil and foundation investigation must be prepared and bear the seal of a registered,professional engineer. 2l Foundations must be designed by and bear the sealof a registered, professional engineer. 3) A topographic survery must be prepared by a registered surveyor, with contour intervals of not more than two feet. 4l Structures must be designed by a licensed architect. If all conditions of approval are met, then the proposed exenption will meet the requirements of Section I of the GarfieldSubdivision Regulations. RECOIII!{ENDATION: Approval with the following conditions: 1. An adequate and legal water supply be obtained and verificationof approval of this supply be provided by the Division of Watgr Resources prior to final approval. 2. That a geological and engineering reportplanning section prior to final approval. This report, shallindicate a suitable building envelope which meets all setback requirements and buildable slope requirements of Section 5.04.02of the zoning regulations. A driveway access permit must be obtained for the 3 acre parcel from the County Road Supervisor prior to final approval. 5. Ewo hundred dollars ($200.00) should be submitted for the school impact fee prior to final approval. 6.
