(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23,1984 Section 2:20.49, the undersigned Diana Josephs Moore petitions the Board oiCouniy Conuriissioucrs of Garlieid County, Colorado, to exempt by Resolution the division of 39.77 6 acre tract of land into 3 tracts of approximately - 13 acres each, more or less, from the definitions of "subdivision" and "subdivided land" asthe terrnsare used and defrned in C.R.S. (1973) Section 30-28-l0l (10) (a) - (d) and the Garfield County Subdivision Regulations for the reasons stated below: To create a 3 Lot subdivision SUBMTTTAL REQUIREMENTS: An application which satishes the review criteria must be submitted with all the following information: A.Skeich map ai a minimum scale of 1"=200' showing the legal description of the property, dimensionandareaofall lotsorseparateintereststo becreated, a@ess to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities; Vicinity map at aminimum scale of l"=2000'showing the general topographic and geographic relation of the proposed exemption to the surrounding arca within two (2) miles, for which a copy of U.S.G.S. quadrangle map may be used. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees ofmineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion; and Evidence of the soil types and characteristics of each type; and Proof o[ legal and adequate source of domestic water for each lot created, method of sewage disposal, and letter o[ approval of fire protection plan from appropriate fire district; and If connection to a corrmunity otmunicipal water or sewer system is proposed, a letter from the governing body stating a willingness to serve; and Narrative explaining why exemption is being requested; and It shall be demonstrated that the parcel existed as described on January 1,1973 or the parcel as it exists presently is one of not more than three parcels created lrom a larger parcel as it existed on January 1,1973. Upon talking to Mr. Adam's about his driveway, h€ indicated he just wanted to get the perm'it and was not interested in constructing the driveway. Because of the special requirements of this driveway, I indicated to Mr. Adams that we would just'issue a temporary permit and once he called for a f inal inspection, and if all the condit'ions were met, we would give h'im a permanent permit for that drive way. And because of that time lapse in there, I to'ld him that if he took out the perm'it, he would have to build the drive way. Otherwise, our department does not have the capabilities topol'ice the s'ituation for a long period of time, and if thelots were to sell to someone e1se, and they were not given the requirements for the drive wdy, then a dangerouss'ituation could develop there. So I feel that if he takes out the permit, the drive way has to be bu'i lt. Another concern about the development of that drive way would be sage brush that wi 1 1 need to be trimmed and cut back so that adequate site distance would be established at a heightof 38 inches off of the finished grade of the drive way. I don't feel that any culvert would be needed w'ith this drive way if grading was properly done. Drainage would run out along Mr. Adam's property and not along the road, and afterthe fill has gone in for the drive way staging area, probably the last four inches of the fill would need to be a good gradation of road base, ih order to establish a strong shoulder there, so that the edge of the county road won't get broken down. The road base shou'ld probably extend fora minimum of 20' from the edge of the road.
