AMENDMENT TO SUBDIVISION IMPROVEMENTS AGREEMENT
FOR THE RIFLE CREEK RANCH
THIS AGREEMEI , made and entered into this .' •/ day
of ---7/y1.44_.0 , 1989, by and betweenANN CATHERINE ROBINSON
(hereinafter referred to as "Developer"), and the Board of County
Commissioners of Garfield County, Colorado, (hereinafter referred to as
the "County").
WITNESSETH:
WHEREAS, an Agreement dated May 30, 1983, between the Developer and
the County was executed as a condition of approval of final plat of the
Rifle Creek Ranch Subdivision (hereinafter referred to as "Property"); and
WHEREAS, the Developer now desires to deliver a letter of credit for
Phase One on October 1, 1989 and complete the construction and
installation of all public improvements identified in Exhibit "B" of the
previous agreement by October 1, 1990; and
WHEREAS, the County is agreeable to allow the property to be developed
in the manner proposed; and
WHEREAS, the parties desire to amend the previously approved
Subdivision Improvements Agreement and amendments thereof, to allow for
the extension of time to post a letter of credit and completion of the
agreed upon public improvements.
NOW, THEREFORE, for and in consideration of the premises and the
following mutual covenants and agreements, the parties hereby agree as
follows:
1. That on or before October 1, 1989, the Developer
shall deliver a letter of credit for construction
of the public improvements in Phase One.
2. That on or before June 1, 1990, the Developer shall
deliver a letter of credit for construction of the
public improvements in Phase Two.
3. The public improvements set forth in Exhibit "B" of the
Subdivision Improvements Agreement entered into by the
Developer and the County shall be completed on or before
October 1, 1990.

4. In all other respects, all terms, conditions and agreements
of the Subdivision Improvements Agreement, referred to above,
shall remain unaltered and in full force and effect.

between Ann Catherine Robinson (hereinafter referred to as "Developer",
and the Board of County Commissioners of Garfield County, Colorado
(hereinafter referred to as "County":), WITNESSETH:
WHEREAS, an Agreement dated May 30, 1983, between the Developer and the
County was executed as a condition of approval of final plat of the Rifle
Creek Ranch Subdivision (hereinafter referred to as "Property");

(hereinafter referred to as "County":), WITNESSETH:
WHEREAS, an Agreement dated May 30, 1983, between the Developer and the
County was executed as a condition of approval of final plat of tne Rifle
Creek Ranch Subdivision (Hereinafter referred to as "Property");
WHEREAS, the Developer now desires to deliver a letter of credit for Phase
One on October 1, 1985, and complete the construction and installation of
all public improvements identified in Exnioit "B" of the previous
agreement by October 1, 1986;
WHEREAS, the County is agreeable to allow the property to be developed in
the manner proposed.
WHEREAS, tne parties desire to amend the previously approved Subdivision
Improvements Agreement to allow for tne extension of time to post a letter
of credit and completion of the agreed upon public improvements.
NOW, THEREFORE, for and in consideration of the promises and the following

and the County shall be completed on or before October 1, 1986.
4) In all other respects, all terms, conditions and agreements of
the Subdivision Improvements Agreement, referred to above, shall
remain unaltered and in full force and effect.

CONSENT TO VACATION OF PLAT
BOOK 628 ME 1S1
Ann Catherine Robinson, as owner of certain real property located in
Garfield County, Colorado, more particularly described in Exhibit "A",
attached hereto and incorporated herein by this reference, and pursuant to
the Subdivision Improvements Agreement, dated the day of
1983, between Ann Catherine Robinson, self, and the Board of County
Commissioners of Garfield County, Colorado, which Agreement, provided inter
alia, that if a letter of credit issued by a National Banking Institution for
the construction of subdivision improvements in a form acceptable to Garfield
County has not been delivered on or before the 1st day of June, 1984, the
subdivision plat of Rifle Creek Ranch shall be vacated in its entirety. By
this instrument delivered to the County of Garfield by the aforesaid Ann
Catherine Robinson, the consent of the undersigned is hereby given to the
filing of such instruments of vacation that the County may deem proper or
advisable.
