NOTICE
Authority. This application for a Building Permit must be signed by the Owner of the property, described above, or
an authorized agent. If the signature below is not that of the Owner, a separate letter of authority, signed by the
Owner, must be provided with this Application.
Legal Access. A Building Permit cannot be issued without proof of legal and adequate access to the property for
purposes of inspections by the Building Division.
Other Permits. Multiple separate permits may be required: (1) State Electrical Permit, (2) County OWTS Permit,
(3) another permit required for use on the property identified above, e.g. State or County Highway/ Road Access or
a State Wastewater Discharge Permit.
Void Permit. A Building Permit becomes null and void if the work authorized is not commenced within 180 days of
the date of issuance and if work is suspended or abandoned for a period of 180 days after commencement.
CERTIFICATION
I hereby certify that I have read this Application and that the information contained above is true and correct. I
understand that the Building Division accepts the Application, along with the plans and specifications and other
data submitted by me or on my behalf (submittals), based upon my certification as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facilities detailed on the submittals reviewed by the
Building Division. In consideration of the issuance of the Building Permit, I agree that I and my agents will comply
with provisions of any federal, state or local law regulating the work and the Garfield County Building Code, OWTS
regulations and applicable land use regulations (County Regulation(s)). I acknowledge that the Building Permit
may be suspended or revoked, upon notice from the County, if the location, construction or use of the structure(s)
and facility(ies), described above, are not in compliance with County Regulation(s) or any other applicable law.

further acknowledge that the issuance of the Building Permit does not prevent the Building Official from: (1)
requiring the correction of errors in the submittals, if any, discovered after issuance; or (2) stopping construction

The following documents pertains 10 EnCana's interest (successors in interest to Tont
Brown, inc.) obtained from Union OiI Company of California on certain lands more
particularly described un Exhibit A attached hereto.
Please be advised, the Purchase and Sale Agreement or the 60 day notice letter from
Union Oil to Chevron are 1101 included due to the teiiris of our Confidentiality
Agreement. Schedules 1-A1 through A-147 arc not included because they are not
relevant to the lands described in the Limited Impact Review application. This narrative
will summarize the key parts of the Agreement as it pertains to the lands described on
Exhibit A.
Special Warranty Deed and Ouit Claim Deed nut including Reservoir Parcel
tinder the terms of the "Purchase and Sale Agreement" dated June 30. 2004 by and
between Tom Brown and Union Oil, Union Oil granted unto Toni Brown Fee title to the
parcels of real property described in Schedules I -A I through 1 A47, subject to the
reservations and restrictions set forth on the Special Warranty Decd and any other .surface
Interest owned by Union Oil further described on the form of a Quit Claim Deed but not
including the Reservoir Land as depicted on Exhibit A (please see the map which shows
the lands in question). Chevron Shale had first right of refusal to acquire the surface and
wafer rights only front Union Oil as described in that certain Deed and Agreement
effective November 9. 1995 between 1 Inion and Chevron on the lands listed on Exhibit
A. Promptly following the execution of said Purchase and Sale Agreement, Union OiI
gave Chevron Shale 60 clays written notice to indicate their election to purchase said
lands. If Chevron failed to respond or acquire these lands within 60 days receipt of this
notice, it was agreed that Union would .sell those lands on Exhibit A to Tom Brown, Inc_
in accordance with the terms of the Purchase and Sale Agreement. The letter was dated
and delivered in accordance with the terms of that certain Deed and Agreement effective
November 9, 1995 to Chevron Shale on July I, 2004.
Under the terms of the Quit Claim Deed dated .lune I I, 2004, it specifically states
"except the fee interest to the surface rights to that parcel of real properly. the legal
description of which k attached as Exhibit A (the "Chevron Reservoir Right of rirs(
Refusal Parcel") and except water storage rights related to such parcel." It further states
in the next paragraph that "Grantor and Grantee agree and intend that this instrument
shall convey to Grantee all of Grantor's interest in and to oil, gas and other minerals in
.Lind under the lands described above (including those under the land described on the
attached Lxhibit A. 'Therefore, the minerals were conveyed but the surface and water
rights were prof as In the lands on Exhihit A. This was still pending Chevron's election to
purchase said lands, which never occurred.
Assignment and Assumption At.reemenl [Reservoir Parcel 1 1)
On September 21, 2004, Union Oil executed the "Assignment and Assumption
Agreement (Reservoir Parcel 11)" and assigned to Toni Brown all right, title and interest
10 the parcel of lands described in Exhibit A. Please note that Exhibit A now describes
these lands as the "Reservoir Parcel", not "Chevron Reservoir Right of First Refusal
Parcel and Water Rights" as they originally were on the Quit Claim and Special Warranty
Deed.

A Special Warranty Deed was also executed and assigned to Tom Brown on September
24, 2004 to include those lands described in Exhibit A. Therefore, Tom Brown was
originally assigned the mineral rights but later assigned the surface and water rights in
accordance with the terms of Chevron's First Right of Refusal.

MEMORANDUM OF PIPELINE & FACILITIES RIGHT OF WAY .AGREEMENT
Pursuant to the terns of that certain unrecorded Pipeline & Facilities Right of Way Agreement
("Agreement") dated cfli:ctive the 1" day of November., 2016 between Piccarice Creel; Ranch.
Ltd", 11 Colorado limited partnership ("Grantor,'), whose address is 11539 County )toad 5, Rifle.
Colorado 81650, and l i►cana Oil R Gas I USA) Enc., a Delaware corporation ("Grantee''), whose
address is 370 I7th Street, Suite 1700, Denver; Colorado 811202. Grantor and Grantee are
collectively refereed to herein as the "Parties",
Under the Agreement, Grantor granted Grantee a nor -exclusive pipeline right-of-way ("Rieftt-
of-\Vat"), upproximatcly fifty (50) feel in width across the Property (as defined below), at the
location generally depicted on the attached I::shihit A. to lay, locate, construct, maintain, inspect.
alter, repair, operate, protect, change the size of, replace, mark and/or remove, one or n►uac
pipelines (the "Pipelines.) with associated appurtenances, equipment and facilities useful or
incidental thereto, including, but not limited tri. valves, metering and corrosion control
equipment, pulnps, electrical lines. generators, and arty above -ground appurtenances
(collectively, the "Above Ground Pipeline Appurtenances") as may be necessary or convenient
for the transportation of water.. petroleum, petroleum products, liquids and derivatives thereof
and any other liquids, gases, or substances which can be transported through the Pipeline;.
Grantor grants to Grantee the tight to install a concrete vault (the "Vault") within the Right -of-
-Way to collect free flowing walei and constituents (the Seep') from the natural drainage,
including water and constituents associated with the springs located within the drainage
uflgradicnt Of the Vault, and the right to withdraw and remove all Seep collected within the Vault
by pipeline off the Property. The Pipeline. .Ahove Ground Pipeline Appurtenances, arid LIiC
Vault trly be collectively referred to as "Remediation Equipment." Grantor also grants to
Grantee a leniporaly easement thirty-five (35) feet in width parallel to and adjoining one side of
the Right -of -bray for use during the initial installation of the Remediation Equipment (the
"Teniporaryy Construction Arca"). The location of the l einporal y Construction Area is generally
depicted on the Fxhhii A attached hereto. Alter the post -construction cleanup feallowiri;,
installation of the Rcrnedia ion Equipment, the: Temporary Construction Area shall terminate and
the Right -of -Way area shall he limited to a strip fifty Beet (50) wide
