At a regular meeting of the Board of County
Commissioners for Garfield, Colorado, held at the Commissioners' Annex in
Glenwood Springs on Monday , the 11th day of July A.D.
1.9 83 there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 83-153
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT
APPLICATION BY NEAL ELLSWORTH.
WHEREAS, the Board of County Commissioners of Garfield County has
received an application from Neal Ellsworth for a conditional use permit`
for a mobile home as accessory use to a ranch operation on the following
described tract of land
Lot 1, Section 30 and Lot 1 of Section 31, Township 6 South, Range 87
West of the 6th Principal Meridian and the SE 1/4 SE 1/4, Section 23;
SW 1/4 SW 1/4, Section 24; Lots 2 and 3, NW 1/4, W 1/2 NE 1/4, N 1/2
SW 1/4, NW 1/4 SE 1/4, SE 1/4 SE 1/4 of Section 25; E 1/2 NE 1/4 of
Section 26; and the NE 1/4 NE 1/4 of Section 36, Township 6 South,`
Range 88 West of the 6th Principal Meridian.
Together with all water, water rights, ditch rights and reservoir and
irrigation rights, of every kind and character, now or hereinafter
used in connection with the said land or appurtenant thereto,
including, but not by way of limitation, the following:
Together with all interest in ,the Strang No. l Ditch and water decreed
thereto under Priority No. 71 for 1.2 second feet, and Priority No. 86
for 1 second foot; and all interest in Strang No. 2 Ditch and priority
No. 36 for .3 second feet of water decreed thereto, and together with
all ditch, reservoir and water rights connected with said land or used
in the irrigation of the above land, including Grantors' 'interest in
the following reservoirs: The Consolidated Reservoir, with Reservoir
Priority No. 8B; the Ralston Reservoir No. 1, with Reservoir Priority
No. 10AAA; the Ralston Reservoir No. 2, with Reservoir Priority No.
1OAA; also all Grantors' interest in the water adjudication decrees in
connection with said Reservoirs; and together with all wells, pumps,
pipe and motors, engines and irrigation equipment now on said land or
used in connection therewith.
WHEREAS, the Board has considered the recommendation.of the Garfield
County Planning Director that a` public hearing is not necessary upon'the
question of whether the above described conditional use permit should be
granted or denied; and
WHEREAS, the Board, on the basis of the said recommendation, has made
the following determinations of fact:
1. The proposed use is compatible with the uses existing and
permitted in the district in which it is to be located, (provided that
certain hereinafter contained conditions be complied with.)
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield
County, Colorado, that a conditional use permit be and hereby is
authorized permitting the use of the above described tract of land for a
mobile home as an accessory use to a ranch operation upon the following
specific conditions:
1. That the use of the tract of land comply with all present and
future regulations of Garfield County relating to mobile homes as
accessory uses to ranch operations in the zone district -in which the
property is now or may later be located.
2. The applicants shall obtain and comply with all county building
and septic permit regulations.

3. The individual sewage disposal system permit shall be obtained at the
time the building permit is issued. and _shall be installed prior to
occupancy.
4. The watersupplysystem shall be available prior to the occupancy of
the building.
5. Skirting around the mobile home shali be securely in place within 60
days after placement of the mobile home anu there shall be no outside
storage.
6. That the mobile home make, year, list price/new purcha-a price and
serial number be submitted to the Planning Section prior to issuance
of.the mobile home special use permit.
7. This permit shall be valid for a period of one hundred twenty (120)
days from the date of issuance thereof unless construction or use has
commenced thereunder; and if construction.or use has not commenced
within this specified period, the permit shall expire..
8. The mobile home shall be placed on a permanent concrete or masonry
footer.
9. The mobile home shall not be rented for occupancy to anyone other than
those employed by the ranch operation.
10.. That the mobile home shall be no less than 720 square feet in size.
