D. 19 86 , there were present: Larry Schmueser Robert. Richardson (absent) Flaven J. Cerise Don DeFord- Mildred 'Alsdorf Chuck Deschenes -Commissioner Chairman Commissioner Commissioner County -Attorney , Clerk. . of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 86--148 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY HIGHLAND LAND COMPANY. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Highland Land Company for a Special Use permit for a commercial park on the following described tracts of land: See Exhibit A (in the State of Colorado and the County of.Garfield); and WHEREAS, the Board held a public hearing on the 8th day of December, 1986, upon the questio., of whether the above-described Special Use permits should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has madethe following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County_. Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County, 4. That the proposed land uses will be compatible with existing and', permitted land uses in the immediate vicinity including, but not limited to, gravel extraction operations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special Use permits be and hereby are authorized permitting the use of the above described tract of land for a commercial park upon the following specific conditions: 1. All representation of the, applicant, either within the application, or stated before the Board of County Commissioners, shall be considered conditions of approval unless stated otherwise by the Board. That the applicant be limited to a total of 12 separate uses on Line site, with a maximum of 8,000 sq. ft. of office and retail space and a 6 -bed bunk room, limited to company employees/truck drivers, to be served by 46 off-street parking spaces on the lot. 3. That the applicant submit proof of approval from the Colorado Highway Department for new or expanded access points where appropriate. 4. That the applicant submit a qualified engineer's statement establishing the adequacy of the central sewage disposal system to handle the proposed uses, to include maximum numbers of occupancy and plumbing facilities sufficient to review future tenants of the site for compatibility with available sewage capacity. The number and -types of uses allowed on the site shall-- be hall -be further restricted in accordance with the limited sewage- capacity. 5. That the applicanti or property owner shall notify the Garfield County Building, Sanitation-, and Planning Department prior to the installment of any new tenant or expansion of existing tenants on the site. In addition, the applicant/owner shall submit plans and specifications at that time to allow for verification of compliance with the Zoning Resolution, Building Code, and. provisions of the special use permit, 6. That the uses to be allowed within the commercial park be limited to those indicated in the application, with the exception of "personal service establishments including bank; barber or beauty shop, laundromat or dry cleaning plant servicing individuals only, mortuary, photo studio, restaurant-, reading room -,`private club, theater, and indoor recreation" 7. That the applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance unless use has commenced.
