A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR PHIL AND PATRICIA LACERTE WHEREAS, t}e Board of County Commissioners of Garfield CountS Colorado, has received application from Phil and Phtricia Lacerte concerned with a Special Use Permit to allow for an Accessory Dwelling Unit, and WHEREAS, the Board held a public hearing on December 3, 2001, upon the question ofwhetherthe above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permiq and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of frct: 1. That proper publication and public notice was provided as required by law for the heaxing before the Board of County Commissioners. 2. That the hearing before the Board ofCounty Commissioners was extensive and corrplste, that all pertinent facts, matters and issues were submitted and that all interested parties wsre heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest ofthe health, safety, morals, convenience, order, prosperityand welfare ofthe citizens ofGarfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for an accessory dwelling unit on a tract of land described in Attachment A, upon the following specific conditions: l. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. Section 5.03.21ofthe Garfield County TnrungResolution, be complied with by the applicant. 3. The applicant will submit plans for the residential portion ofthe structure and have an individual qualified in residential construction inspection certfy the construction's compliance with the 1994 UBC requirements. Additionally, the applicant will have to pay double fees for the building permits, per the Building Code requirements. 4. A professional engineer, licensed in the State of Colorado, will certifr the adequacy and installation of the ISDS being consistent with the County and State ISDS regulations 5. Any violation of the terms, interpretations or agreements made or represented to Garfield County by the applicant pertaining to or included in this Special Use Permit, shall be considered a breach of the terms of conditions and the applicant shall cease and desist all activities and may be subject to revocation of the special use permit. 6. Prior to the issuance of the Special Use Permit: the following documentation will be provided to the Planning Department: a) That a four (a) hour pump test be performed on the well to be used;b) A well completion report demonstrating the depth ofthe well, the characteristics ofthe aquifer and the static water level; c) The results of the four (a) hour pump test indicating the purnping rate in gallons per minute aod information showing drawdown and recharge;d) A written opinion ofthe person conducting the well test that this well strould be adequate to supply water to thc number of proposed lots;e) An assumption of an average or no less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day; D The water quality be tested by an approved testing laboratory and meet State guidelines concerning bacteria nitrates and suspended solids; fl[uu]l uil rilr mrith ilil iluril tllr tllr64418s Lt/os/zoa3 o3:2?p srsss pz6z r hliiibnF'3 of 4 R o.Oo D O.OO GRRFIELD coUNTy Co Dated this :ra day of Novenber , A.D. 2003 ATTEST:GARFIELD COTINTY BOARD OF COMMI SSI ONERS, GARFIELD COUNTY, COLORADO Upon motion duly made and seconded after the hearing on Decembe r 3 ,2001 ,the foEgoing Resolution was adopted by the following vote: John Martin Aye ,; . -iir.
